The Social Security Administration (SSA) intends to negotiate solely with Dakota Systems, Inc. for the subscription renewal of Syncro Soft Oxygen XML Web Author license software and maintenance, 163 (ea), (previously P.O. 28321320P00050102) under the authority of FAR 13.106-1(b)(1)(i), “Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available”. These subscription licenses can only be renewed through Dakota Systems, Inc., because Dakota Systems, Inc. used their custom application to incorporate the licenses into the solution. Therefore, that component is part of the solution and cannot be separated or used independently of their solution. This requirement is utilizing procedures in FAR Part 12 in conjunction with procedures in FAR Part 13. A determination by SSA not to compete this proposed requirement based upon responses to this notice is solely within the discretion of SSA.
