This amendment includes an attachment containing questions and answers on this solicitation, and an attachment that contains example brokerages. The amendment includes the attachments at the end and the attachments are also uploaded as separate files for convenience. Proposals are still due July 19, 2024 at 1:00pm eastern time. _________________________________________________________________________________________________________ (i) This is a combined synopsis/solicitation that will provide electronic data feeds services in accordance with the attached Statement of Objectives. This RFP is in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, and FAR 13.5 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. FAR Parts 14 and 15 are not applicable to this acquisition as only commercial (FAR 12.6) and streamlined acquisition procedures (FAR 13.5) are being used. (ii) The solicitation number is 50310224R0010 and is issued as a Request for Proposals (RFP). (iii) The synopsis/solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-05 effective May 22, 2024. (iv) The associated NAICS code is 541511; and the applicable business size standard is $34M. There is no small business set-aside for this acquisition. Solicitation number 50310224R0010 is a full and open competition. (v) See the attached SF 1449, SOLICITATION/CONTRACT/ORDER FOR COMMERCIAL ITEMS for the list of line item number(s) and items, quantities, and units of measure (including option(s), if applicable). (vi) Description of requirements for the items to be acquired. See ATTACHMENT 3, OEC eFeeds Statement of Objectives (SOO). (vii) Date(s) and place(s) of delivery and acceptance and FOB point. The anticipated contract’s period of performance will be for one (1) year from date of award, with four (1) one-year options. The FOB point is destination. The anticipated start date for this requirement is September 30, 2024. Work is to be performed at the contractor’s site. (viii) The provision at 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services (SEP 2023), applies to this acquisition as amended/supplemented in the attached SF-1449, SOLICITATION/CONTRACT/ORDER FOR COMMERCIAL ITEMS, for proposal submission instructions, Section 11 – Instructions to Offerors. (ix) The provision at 52.212-2, Evaluation-Commercial Products and Commercial Services is not applicable. See the attached SF-1449, SOLICITATION/CONTRACT/ORDER FOR COMMERCIAL ITEMS, for evaluation criteria in Section 12. (x) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, with its offer. (xi) FAR 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services (NOV 2023), applies to this acquisition, WITH PARAGRAPHS AMENDED AS FOLLOWS: (s)(2) (“The Assignments, Disputes, Payments, Invoice, Other Compliances, Compliance with Laws Unique to Government Contracts, Unauthorized Obligations paragraphs of this clause, and SECI 7001.00, Commercial Supplier Agreements – Unenforceable Clauses.”), and (s)(4) (“Addenda to this solicitation or contract, including any license agreements as amended by SECI 7001.00, Commercial Supplier Agreements – Unenforceable Clauses.”). (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Products and Commercial Services, applies to this acquisition. (xiii) Additional contract requirement(s) and terms and conditions that apply to this requirement are included in the attached SF-1449, SOLICITATION/CONTRACT/ORDER FOR COMMERCIAL ITEMS. (xiv) The Defense Priorities and Allocations System (DPAS) is not applicable.
