Pursuant to Federal Acquisition Regulation (FAR) subpart 13.106-1(b), Soliciting from a single source the U.S. Nuclear Regulatory Commission (NRC), Office of the Inspector General (OIG), intends to issue a sole source purchase order to Kator, Parks, Weisser, and Harris, LLC 1200 18th St. NW, Suite 1000, Washington, DC 20036 under the authority of Federal Acquisition Regulation subpart 13.106-1(b)(1)(i). The NRC proposes to enter into a sole source arrangement with Kator, Parks, Weisser, and Harris, LLC for expert, high level legal services, to include counsel, advice and representation for the evaluation, assessment, negotiation, and litigation of filed and potential discrimination/misconduct/fitness for duty cases within the NRC OIG. Kator, Parks, Weisser, and Harris, LLC has been successfully providing the NRC’s OIG with the expert legal services required under the current contract NRC HQ-30-17-C-0001. This firm understands the background information related to the requirements and functioning of the Office of the Inspector General. and possesses the specialized knowledge and experience necessary to meet the specific needs of the OIG. This firm also has a current understanding of the ongoing legal matters within the OIG, and this sole source arrangement will eliminate the need for knowledge transfer on matters with strict deadlines set by external adjudicatory bodies. The Period of Performance shall be a Base Period from December 1, 2021 through November 30, 2022 and four one-year Option Periods. The total estimated value of this purchase order is approximately $100,000 - $125,000, inclusive of the Base and all Option Periods. The applicable North American Industry Classification System (NAICS) code for this acquisition is 541110 “Office of Lawyers” and size standard is $12 million. The Government intends to solicit and negotiate directly with the Kator, Parks, Weisser, and Harris, LLC, and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, if any interested party believes they can meet the above requirements, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the government to determine if the party can perform the requirements. Additionally, in order to perform work for the NRC, potential sources must be free of conflict of interest (COI). A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government.
