This notice is a Draft Request for Proposal (DRFP) Sections L and M and certain attachments issued pursuant to NASA FAR Supplement 1815.201. You are invited to review and comment on the NASA Langley Research Center’s (LaRC) issued Draft Section L and M for IAD. 1. DRFP Section L contains important information for proposal preparation. DRFP Section M sets forth the evaluation criteria and method for award. 2. The Government intends to award the contract(s) resulting from this solicitation without discussions. See Section L provision 52.215-1, Instructions to Offerors - Competitive Acquisition (JAN 2017). To facilitate this process, we would like to avoid situations where proposals include substantive exceptions to the proposed contract terms and conditions, which might be unacceptable to the Government and, therefore, preclude award. The resolution of any exceptions to the proposed contract terms and conditions prior to receipt of proposals will aid the Government in its intention to award without discussions and thus streamline the procurement process. 3. The Government would like to call your attention to provision L.17 as Tracks B and C are to be set-aside for small business, contingent upon approval of the final procurement strategy. The NAICS code is 541715, Research and Development in Physical, Engineering, and Life Sciences (except biotechnology and nanotechnology). 4. A pre-proposal conference will be held after the release of the Final RFP. We solicit all questions via email at LaRC-OP-IAD@mail.nasa.gov and they will be answered by amendment to this notice posted in Sam.gov. Below are tentative dates for key milestones for the IAD Procurement Schedule: Release of the Final Request for Proposal: January 14, 2022 Award Date of the Contract (s): September 14, 2022 Contract Start Date: November 1, 2022 5. Please note the mandatory Page limitation Provision: Provision L.18, 1852.215-81, PROPOSAL PAGE LIMITATIONS, includes specific page limitation and format requirements. PAGES SUBMITTED IN EXCESS OF THE LIMITATIONS SPECIFIED IN THIS PROVISION WILL NOT BE EVALUATED BY THE GOVERNMENT. 6. While comments are sought on the entire DRFP Section L and M, NASA LaRC requests that prospective offerors give special attention to the following areas for potential comments: a. This procurement anticipates awarding Multiple award Indefinite-Delivery, Indefinite-Quantity (IDIQ) type contracts with an estimated 10-year period of performance (contingent upon approval of the final procurement strategy) which will include Cost-Plus-Fixed-Fee (CPFF) or Firm Fixed Price (FFP) task orders. Industry is invited to provide suggestions/comments regarding the pros and cons of exceeding a 5-year period of performance. b. The IAD contract will be awarded as a multiple award Indefinite Delivery Indefinite Quantity (IDIQ) contract, which offers the most flexibility for the work under this contract. The proposed approach to distribute work by technical track as described in the Statement of Work (SOW) has been included to maximize competition and allow for multiple technical concepts. The multiple award IDIQ may award to multiple companies under each technical track. Based upon industry knowledge of the SOW, is this a proposed approach viable to perform the work? c. Given the nature of the services required by the draft SOW, we do not anticipate any organizational and personal conflicts of interest. However we advise interested offerors to review the NASA FAR Supplement Clause 1852.209-71, Limitation of Future Contracting in order to avoid potential or actual conflicts of interest and notify Ceseley Dunbar at LaRC-OP-IAD@mail.nasa.gov, if you anticipate a potential Organizational Conflict of Interest (OCI). The Limitation of Future Contracting clause contains prohibitions on the successful offeror performing or competing for work associated with the performance of task orders awarded under this contract. d. The IAD procurement groups technical tracks of work described in the SOW as either unrestricted or small business set-aside award as follows: (A) Inflatable Structures Design, Fabrication (including Aeroshell Integration), and Testing (Full and Open) (requires a Subcontracting Plan), (B) Flexible Thermal Protection Systems Design, Fabrication (including Aeroshell Integration), and Testing (Small Business Set-Aside), and (C) Gas Generator Inflation System Design, Manufacturing, and Testing (Small Business Set-Aside). Multiple awards will be made to offerors in each technical track. Offerors can propose to all or some of the technical tracks for which they are eligible for award. The Government anticipates awarding up to 3 contracts for Track A and 2 for B and anticipates 3-4 contracts, but reserves the right to award up to 6 for Track C. Is this a viable approach to support this contract and perform the work? e. For Small Businesses, the IAD procurement will contain FAR 52.219-14 (Deviation 19-02), Limitations on Subcontracting, which is a required clause for small business set-asides. The Limitation of Subcontracting Clause states in part that “by submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for- (1) Services (except construction). It will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded.” Compliance with this requirement is further defined in 13 CFR §125.6. As the prospective offeror, do you anticipate any issues with this requirement? If so, why? f. Cost Forms, please review and submit questions and/or comments if there are any concerns. g. L.17 Technical Considerations. Given the Statement of Work and Technical considerations is there sufficient definition to provide an IAD approach and define your capabilities needed? If not, which areas need clarification? h. Attachment L-7 for Large Business, are the goals for the various types of small business subcontracting reasonable? NASA appreciates the comments to be received in response to the release of the draft Section L and M and attachments include here. The comments are expected to result in improvements to both the quality and the content of the final RFP. This Draft RFP Section L and M does not commit NASA LaRC to pay any proposal preparation costs, nor does it obligate NASA LaRC to procure or contract for these services. This request should not be construed as authorization to proceed with, or be paid for, charges incurred by performing any of the work called for in this draft solicitation.
