Bennett swing space (this work will be completed under a separate contract), and 2) include the updated evaluation factors. ----------------------------------------------------------------------------------------------------------------- This is a pre-solicitation notice for the U.S. General Services Administration (GSA), Public Buildings Service (PBS), Region 8. This is not a solicitation announcement and there is no request for a proposal or related documents at this time. This synopsis is exclusively to publicize information about a project opportunity for Construction Manager as Constructor (CMc) services required for the Frank E. Moss U.S. Courthouse Seismic Upgrade, Backfill, and Building Renovation located in Salt Lake City, Utah. Project Description: The primary objectives of this project are to improve the overall seismic performance of the building for the safety of its occupants in accordance with the PBS P100 as a result of a February 2, 2016 Executive Order 13717 Establishing a Federal Earthquake Risk Management Standard; back-fill the Frank E. Moss U.S. Courthouse with federal agencies, some of which are currently housed in private market leases within the Salt Lake City metropolitan area; preserve and rehabilitate significant historic spaces; and invest in building systems that are at the end of their useful life, improving the overall performance of the building and tenant comfort. The project also includes the construction of swing space. The intent is to execute the seismic modernization and backfill of the Frank E. Moss U.S. Courthouse with the building vacated. The project’s minimum target is LEED Gold Certification; however the goal is LEED Platinum Certification. The project shall maximize space utilization for the agencies, creating an advanced and modern work environment. The project team shall ensure a high performing building that employs a whole building design approach which maximizes the building’s original construction and inherent characteristics to drive efficiency cost effectively. The project team will collaborate in order to deliver an award winning project which embraces the ethos of design excellence, construction excellence, balances preservation and advanced technology, and exhibits a high degree of ingenuity, and creativity. Project History: GSA has contracted with a separate Architect-Engineer (AE) firm that is responsible for developing complete design and construction documents for the Frank E. Moss U.S. Courthouse. In addition, the GSA has contracted with a separate Construction Manager as Advisor (CMa) firm to provide certain services during the design and construction phases of the project. The project site is located at 350 South Main Street in downtown Salt Lake City, UT. The site is bound by Main Street to the East, University Boulevard to the South, West Market Street to the North, and the new U.S. District Courthouse and plaza to the West. The Frank E. Moss U.S. Courthouse is a contributing structure in the historic Exchange Place District of downtown Salt Lake City, designed in the Neoclassical Revival style. The building was originally designed by Supervising Architect of the Treasury, James Knox Taylor, and constructed in 1905 serving as a Federal Courthouse and U.S. Post Office. The structure was expanded to the west in 1912, enclosing the “U” shaped structure. In 1932 the building was expanded to the South almost doubling the structure in size and mimicking the central lightwell configuration of the 1905 and 1912 structure. The Courthouse was listed on the National Register of Historic Places in 1978. The building has five principal floor levels as well as a basement, and serves as a Federal Courthouse and Federal Office Building. It comprises of approximately 234,000 gross square feet with approximately 152,000 usable square feet. The use post construction will remain the same, serving as a multi-tenant federal office building and Courthouse for the U.S. Bankruptcy Courts. General CMc Statement of Work (SOW): The CMc contract will include two distinct phases: 1) Design Phase Services (base services) and, 2) Construction Phase Services (optional services). The CMc delivery method will allow full collaboration between the CMc contractor and the Architect-Engineer contractor throughout the design process. Design phase services for the CMc will include, but are not limited to, the CMc shall review and become familiar with the scope of services under the A/E’s contract, especially the various standards, guidelines, policies, and documents that the A/E is required to follow in developing the design and construction documents. This review and familiarization is vitally important during the Design Phase Services because, as set forth in more detail below, the main tasks of the CMc Contractor during the Design Phase Services are to provide constructability and cost estimation reviews of the A/E’s design-related submissions. At its core, the CMc Contractor will help to ensure that the design and construction documents will enable the Government to exercise the Guaranteed Maximum Price (GMP) Option at a price that is at or below the GMP. Subject to the exercise of the GMP option, the CMc shall provide all supervision, labor, materials, and equipment to provide all required construction services for the seismic upgrades, preservation of significant historical aspects, construction for backfill of tenant space, and modernization of building systems to create an efficient, and comfortable working environment. Project Duration and Schedule: The contractor shall refer to the Contract, however it is anticipated that the following milestones shall be approximate dates of what to follows: Base Design Services Notice to Proceed (Moss Courthouse): May 2021 Construction Documents Phase Complete (Moss Courthouse): February 2022 Construction Notice to Proceed (Moss Courthouse): March 2022 (or upon construction completion/occupancy Bennett Swing Space to be completed under a separate contract) Anticipated Dates for Procurement of Project: The anticipated dates in this synopsis are for informational and planning purposes and may be subject to change. Issue of Solicitation: December 2020 Site Visit: January 2021 Technical Proposals Due: January 2021 Price Proposals Due: March 2021 Contract Award: May 2021 NAICS: The NAICS code for this procurement is 236220, Commercial and Institutional Building Construction. Subcontracting: In accordance with FAR subpart 19.702(a)(1), a subcontracting plan is required as part of the negotiated agreement for the project opportunity. Failure to submit a subcontracting plan may result in ineligibility for contract award. The requirements of a subcontracting plan are described in FAR subpart 19.704. Set-Aside: The Government does not intend to set-aside the requirement for small business concerns. Contract Type: The base contract for design services is anticipated to be awarded at a firm-fixed price. The initial contract award will also include an Estimated Cost of Work (ECW) and proposed fixed fee. The Government will hold any available contingency allowance. The fee for construction work includes the CMc’s indirect cost, including overhead and profit for construction phase services. The ECW and Fee for Construction Work constitute the Guaranteed Maximum Price (GMP). The GMP is inclusive of the proposed fixed fee. The ECW may adjust based on design phase services to negotiate a final ECW, but the fee for construction work does not adjust. The GMP will be tracked through open book accounting that will be reviewed and monitored by GSA and the Construction Manager as Agent (CMa). The GMP is similar to a ceiling price described in FAR subpart 16.403-2, but is specifically tailored for CMc project delivery. An initial profit adjustment formula to be used for establishing the firm target profit, including a ceiling and floor for the firm target profit. (This formula normally provides for a lesser degree of contractor cost responsibility than would a formula for establishing final profit and price.) A ceiling price that is the maximum that may be paid to the contractor, except for any adjustment under other contract clauses providing for equitable adjustment or other revision of the contract price under stated circumstances. After the parties have agreed to the scope at 100% completed design, the Government and the CMc may agree to bilaterally modify the line item for Construction Phase services from the GMP to a firm-fixed price. The firm-fixed price must not be in excess of the GMP. Construction Phase Services are only required if the Government elects to exercise the option. The Government reserves the right not to exercise the option for Construction Phase if the final sum of the ECW and Fee for Construction Work exceeds the GMP, there is no agreement on the scope, or if it is not in the Government’s best interest to proceed. The project will still be in the design phase when the CMc contract is awarded; therefore, a firm-fixed price cannot be established for Construction Phase Services. The benefit of awarding the CMc contract for Design Phase Services prior to completion of design is that the firm will provide constructability reviews, project coordination, cost estimates, and other specified services to allow for full collaboration with the A/E, GSA, customer agencies, and other stakeholders during design. CMc also provides a benefit through allowing certain construction activities to begin prior to design completion. Certain activities may be identified for fast track completion to deliver the project quicker than alternative methods of project delivery. Early work packages must be converted to a firm-fixed price once the scope is fully specified. Price: The GMP at award of the construction option is the sum of the final ECW and Fee for Construction Work. The ECW is the estimated direct cost of the construction work. The target ECW is incorporated at award, as part of the GMP. The final ECW is negotiated during design phase services and incorporated into the option for the construction phase services after 100 percent design completion. The Fee for Construction Work is the fixed amount established in the contract for all the CMc’s indirect costs, inclusive of profit and overhead for the construction services. The Fee for Construction Work does not adjust based on the ECW. The Government and CMc may agree to GMP line items for early work packages that may be converted to firm-fixed price. The construction services option is adjusted for the cost of the work packages through the reduction of the ECW by the fixed-price amount of the cost of those work packages, and the GMP is adjusted downward, as appropriate. The estimated total price range for the Project is between $75,000,000 and $90,000,000. Bonding: Contractors will be required to provide a bid bond for the requirement and have sufficient bonding capacity for the proposed work. Information on Proposal Submission: The Government plans to conduct a competitive negotiated acquisition. The Government will use source selection procedures in FAR Part 15 to evaluate proposal packages. The Government reserves the right to award without discussions; however, the Government may evaluate proposals to create a competitive range of the most highly rated contractors. Accordingly, the Government may establish a competitive range to conduct negotiations with the most highly rated contractors if benneficial. The competitive range may exclude highly rated proposals that may otherwise be included in the competitive range if it is necessary to achieve efficiency in competition among the most highly rated proposals. The Government will make a selection based on the proposal that represents the best value to consider past performance, technical factors, and price through a tradeoff process and other procedures described in the solicitation. In the Government’s evaluation of proposals, the non-price factors, when combined, are significantly more important than price. The price proposal includes design phase construction management services to include but not limited to constructability reviews, cost estimation, schedule phasing review, and value engineering. The total price of the construction phase work is set by a GMP. Accordingly, the Government intends to evaluate the price proposal for the design phase services and the CMc GMP Option price for Construction Services. The Government source selection board members will evaluate the following non-price factors: 1) Offeror’s Experience, 2) Offeror’s Past Performance, 3) Technical Approach, 4) Key Personnel Past Performance, and 5) Project Labor Agreement. Please note that factors may change slightly in release of the formal solicitation. Factor 1 – OFFEROR’S EXPERIENCE Description: This factor considers the extent of the offeror’s experience on Similar Projects as the prime contractor. The offeror should demonstrate that as the prime contractor it has completed at least two Similar Projects. Submittal Requirements: The offeror should provide a minimum of two (2) and no more than four (4) examples of Similar Projects that it completed as prime contractor. The Government will only consider for this factor the first four projects submitted under this factor in the offeror’s Technical Proposal. The submission of the description for each project is limited to a maximum of four (4) pages. For this Factor 1, the Government will also consider the information submitted under Factor 2 regarding Section 1 of Attachment 1 – Offeror Past Performance Questionnaire. A more favorable rating will be given to an offeror to the extent it can demonstrate the following: as the prime contractor it has substantially completed (as of the initial proposal due date for this solicitation) more than two Similar Projects, or any of the Similar Projects it has substantially completed (as of the initial proposal due date for this solicitation) as the prime contractor also included total seismic building stabilization. Factor 2 – OFFEROR’S PAST PERFORMANCE Description: This factor considers the offeror’s past performance as prime contractor on Similar Projects it has substantially completed as of the initial proposal due date for this solicitation. Submittal Requirements: For each Similar Project example provided in response to Factor 1, the Offeror shall, after completing Section 1, distribute Attachment 1 - Offeror Past Performance Questionnaire to each Reference for completion of Section 2. The References shall email the completed Attachment 1 - Offeror Past Performance Questionnaire to Rhonda Widick, Contracting Officer at rhonda.widick@gsa.gov no later than the initial proposal due date for this solicitation. Non-compliance with any of the requirements of the preceding two sentences for an Attachment 1 – Offeror Past Performance Questionnaire means that the Government will not consider that Attachment 1 – Offeror Past Performance Questionnaire information for Factor 2. Past performance ratings for Similar Projects found in the Contractor Performance Assessment Reporting System (CPARS) or Past Performance Information Retrieval System (PPIRS) may also be used to evaluate each offeror’s past performance. Factor 3 – TECHNICAL APPROACH Description: This factor considers the offeror’s proposed technical approach in its CMc delivery method approach covering design phase services and construction phase services in the scope of work to meet the contract requirements. Submittal Requirement: The offeror’s technical approach narrative shall be no more than ten (10) single-sided, 8½“ x 11” pages, single spaced, and with a minimum 10 point font. The Government will only consider the offeror’s first five pages in response to this factor. The technical approach narrative should at a minimum: demonstrate that the offeror’s CMc delivery method approach covering the design phase services and the construction phase services will meet the contract requirements; display at least a basic understanding of the CMc delivery method in compliance with contract requirements in its CMc delivery method approach covering design phase services and construction phase services in the scope of work. A more favorable rating will be provided to the extent the offeror’s technical approach meets contract requirements and is able to demonstrate the optimization of the design and construction outcome within the project budget (by approach, application or construction methods) related to the following systems in the scope of this project: Seismic upgrade components and installation; Management, coordination, and protection of historic finishes; Mechanical, electrical and plumbing systems; or Other systems within the project scope. By submission of its offer, each offeror agrees that any of its technical approach, in part or in whole, submitted in response to this solicitation becomes the property of the Government at no cost to the Government regardless of whether the offeror receives award of the contract. Factor 4 – KEY PERSONNEL PAST PERFORMANCE Description: This factor considers the relevant past performance (for at least one year) of the offeror’s proposed key personnel (project manager and construction superintendent) on substantially completed (as of the initial proposal due date for this solicitation) Similar Projects in the key personnel position proposed. Submittal Requirements: The offeror shall provide no more than four examples of Similar Projects that each proposed key personnel has performed (for at least one year) in the key personnel position proposed. The Government will consider only the first four of such examples. For each project performed by each proposed key personnel for Factor 3, the Offeror shall, after completing Section 1, distribute Attachment 2 - Key Personnel Past Performance Questionnaire, to each Reference for completion of Section 2. The References shall email the completed Attachment 2 – Key Personnel Past Performance Questionnaire to Rhonda Widick, Contracting Officer at rhonda.widick@gsa.gov no later than the initial proposal due date for this solicitation. Non-compliance with any of the requirements of the preceding two sentences for an Attachment 2 – Key Personnel Past Performance Questionnaire means that the Government will not consider that Attachment 2 – Key Personnel Past Performance Questionnaire information. Any additional information the Government becomes aware of for evaluation of each key proposed key personnel under this factor may be considered as part of the past performance evaluation. Factor 5 – PROJECT LABOR AGREEMENT Description: This factor considers whether the Offeror has submitted a price proposal subject to the Project Labor Agreement (PLA) requirements in accordance with the solicitation document. A proposal submitted subject to the PLA requirements set forth in this solicitation will receive full credit under this evaluation factor. A proposal submitted not subject to such PLA requirements will receive no credit under this evaluation factor Submittal Requirement: Offerors may submit a proposal subject to PLA requirements set forth in the solicitation (a PLA proposal), a proposal not subject to the PLA requirements set forth in this solicitation (a non-PLA proposal), or both. If an offeror submits a PLA proposal and a non-PLA proposal, the offeror shall document for each proposal the differences between the two with a track changes feature showing both deleted and added proposal content. Offerors that do not clearly track the differences between the two proposals may not receive an evaluation for unidentified differences between the two proposals.
