This Justification for an Exception to Fair Opportunity is issued in support of the National Deep Energy Retrofit Program (NDER) Round 5, Energy Savings Performance Contract (ESPC) at Multiple Locations in Louisiana and Texas. Modification PS0006 added Energy Conservation Measure (ECM) 17 - Retro-Commissioning (CARES) for National Outdoor Ventilation Air (NOVA), Coronavirus Aid, Relief, and Economic Security (CARES) Act at Terminal Annex and Earle Cabell Federal Buildings in Dallas, Texas. The NDER 5 ESPC Task Order No. 47PH1123F0001 was issued under Department of Energy (DOE) ESPC Indefinite Quantity/Indefinite Delivery (IDIQ) Contract No. DE-EE008027. This project is for the procurement of energy audit services and related constructive services to complete the selected ECMs in accordance with the Government's intent to reduce energy and water usage. GSA's intent is to use the energy and water savings resulting from the task order to help the agency move toward meeting the requirements of Executive Order 13834 and Energy Independence and Security Act of 2007.
