This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions". General Services Administration, Public Building Services intends to award a sole source, firm-fixed price contract with Temperature Controls, 10315 Brockwood Rd., Dallas, Texas 75238. Authority FAR 13.106(b)(i) "Soliciting from a single source" (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). Temperature Controls offers end users of the N4 software a viable licensing solution that would reduce overall Government cost by allowing the Government to act as its own distributor, thereby allowing the movement of licenses between computers thereby allowing the movement of licenses between computers and eliminating the need to repurchase. A SOLICITATION WILL NOT BE POSTED The Government intends to proceed with this sole source action. The NAICS code is 334512. The small business size is 150 employees THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS A solicitation will not be posted. The Government intends to proceed with this sole source action. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
