As outside temperatures rose, the U.S. Marshalls Service noted severe and excessive indoor heat causing prisoner health and safety concerns. Immediate action is needed to remove and replace AHU-2D freeze damaged coils. The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-2, unusual and compelling urgency.
