This notice is neither a solicitation announcement, nor a request for proposal or related documents. Project Description: This Presolicitation Notice is for Construction Manager as Constructor (CMc) services for the Major Building Modernization project located at the Silvio J. Mollo Federal Building (Mollo) at 1 Saint Andrews Plaza in New York, NY. At the end of this project, the U.S. Department of Justice - Attorney’s Office (USAO) Criminal Division, which will be temporarily relocated to the Jacob K. Javits Federal Building at 26 Federal Plaza, in New York will move back to Mollo. The CMc shall be a member of the project development team during the design and construction phases of the project, working with the Government's selected Architect-Engineer (A/E), Construction Manager as Advisor (CMa), and the Government representatives to ensure a quality project, within the mandated schedule and budget. The CMc contract will include two phases of work: Design Phase Services and Construction Phase Services. The CMc will perform Design Phase Services including, but not limited to: scheduling, estimating and providing cost information, performing functionality and constructability reviews, developing construction sequencing and phasing plans, value management, risk management, and engagement and coordination with stakeholders, municipal offices and state agencies such as the New York City Department of Transportation, the New York City Department of Buildings, the New York City Department of Parks and Recreation, the City’s Department of Citywide Administrative Services and the New York City Police Department. The construction portion of the project will include a complete exterior envelope replacement (including the façade and roof), and addressing seismic, structural and blast mitigation deficiencies. The project will modernize Mollo’s vertical transportation, mechanical, electrical (normal and emergency), plumbing, fire protection and security infrastructure. In addition, the project will include a new security screening pavilion, accessibility upgrades and integrated main entrance. As part of the Construction Phase Services, the project will provide new interiors for the USAO and other Department of Justice offices. The project also will provide a new mechanical plant to provide chilled water and high-pressure steam service to the adjacent Department of Justice – Federal Bureau of Prisons’ Manhattan Metropolitan Correctional Center (MCC). Contract Type: The contract type will be Fixed-Price-Incentive. The base contract for design services is anticipated to be awarded at a firm-fixed price. The initial contract award will also include an Estimated Cost of Work (ECW), CMc Contingency Allowance (CCA), and proposed Fixed Fee. The ECW is set by the Government at $140,000,000 to $150,000,000 for the project. The ECW is the estimated cost of the construction work, not including the vendor’s administrative overhead expenses. The CCA is an allowance to cover reimbursable costs during construction that are not the basis of a change order. The Fee for Construction Work is the amount established in the construction contract for the CMc's profit and administrative overhead expenses for the Construction Phase Services. The sum of the ECW, CCA, and Fee for Construction Work constitute the Guaranteed Maximum Price (GMP). The GMP is inclusive of the proposed Fixed Fee. GSA may adjust the ECW based on design phase services to negotiate a final ECW, but GSA will adjust the Fee for Construction Work. The GMP will be tracked through open book accounting that will be reviewed and monitored by GSA and the CMa. The GMP is similar to a ceiling price described in FAR 16.403-2, but is specifically tailored for CMc project delivery. After the CMc and GSA have agreed to the scope at 75% design completion, the Government and the CMc may agree to bilaterally modify the line item for Construction Phase Services from the GMP to a firm-fixed price. The firm-fixed price for Construction Phase Services must not be in excess of the GMP. Construction Phase Services are only required if the Government elects to exercise the option. The Government reserves the right not to exercise the option for Construction Phase Services if the GMP exceeds $195,000,000 - $205,000,000, if there is no agreement on the scope, or if it is not in the Government's best interest. The project will still be in the design phase when the CMc contract is awarded; therefore, a firm-fixed price cannot be established for Construction Phase Services. The benefit of awarding the CMc contract for Design Phase Services prior to completion of the design is that the firm will provide constructability reviews, project coordination, cost estimates, and other specified services to allow for full collaboration with the A/E, CMa, GSA, USAO, other U.S Department of Justice Offices, and MCC officials. CMc also provides benefits through allowing certain construction activities to begin prior to design completion. Certain activities may be identified for fast track completion (e.g. demolition as an early work package or facade mock-ups) to deliver the project quicker than alternative methods of project delivery. Early work packages must be converted to a firm-fixed price once the scope is fully specified. Price: The ECW range is set by the Government at $140,000,000 - $150,000,000, and the target ECW is incorporated at award as part of the GMP. The final ECW is negotiated during Design Phase Services and incorporated into the option for the construction services after 75% design completion. The Government and CMc may agree to GMP line items for early work packages that must be converted to a firm-fixed price. The construction services option is adjusted for the cost of the work packages through the reduction of the ECW by the fixed-price amount of the cost of those work packages, and the GMP is adjusted downward, as appropriate. Selection and Schedule: This requirement will be procured under Full and Open Competition in accordance with FAR Subpart 6.1. The selected offeror will be competitively chosen using Source Selection Procedures in accordance with FAR Subpart 15.3. The objective of the Source Selection Process is to select a proposal that represents the best value to the Government. The period of performance for the base Design Phase Services will be from September 2022 to December 2023. The period of performance for the Construction Phase Services option (if exercised) is estimated to be from June 2024 to January 2027. Magnitude of Construction: The Estimated Cost of Construction at Award range is $170,000,000 to $180,000,000. NAICS: The North American Industry Classification System (NAICS) code associated with this procurement is 236220, Commercial and Institutional Building Construction, and the U.S. Small Business Administration size standard is $39.5 million. Solicitation Information: GSA anticipates issuing the Solicitation on or about November 15, 2021, with receipt of proposals at a minimum of thirty (30) calendar days later. All information, amendments and questions concerning this solicitation will be electronically posted to the Government-wide Point of Entry at SAM.gov. No telephone requests will be accepted and no paper copies will be mailed to prospective offerors. All offerors are required to have an active registration in the System for Award Management (SAM.gov) at the time of offer submission. Information received will be used to determine the availability of responsible firms that would be interested in submitting proposals in response to the anticipated solicitation. The U.S. General Services Administration (GSA), Public Buildings Service, Northeast and Caribbean Region is seeking a qualified General Contractor to act in the capacity of a Construction Manager as Constructor (CMc) who can provide full Construction Services for a comprehensive whole building modernization project at the Silvio V. Mollo Federal Building (Mollo) located at 1 St. Andrew’s Plaza in New York City, New York. The proposed Mollo project will include a complete exterior envelope replacement, and address seismic, structural deficiencies and blast mitigation. The project will replace and modernize the building mechanical, electrical distribution, plumbing, fire protection and security systems. In addition the project will construct a new screening pavilion and new office for the U.S. Department of Justice– Attorney’s Office (USAO) for the Southern District of New York. The scope includes complete replacement of building systems, including the facade, roofing, HVAC, normal and emergency electrical infrastructure, and elevators. The project also includes accessibility upgrades, a new integrated main entrance, construction of tenant space for the USAO and U.S. Department of Justice– Marshals Service (USMS), and temporary chilled water and High Pressure steam service to the adjacent U.S. Department of Justice–Federal Bureau of Prisons’ Manhattan Correctional Center (MCC). The overall project will be executed in three phases. Phase I is for swing space in the Jacob K. Javits Federal Building (Javits) located at 26 Federal Plaza in New York City, New York, that will be required so tenants can vacate the existing Mollo facility during construction (Phase II). The swing space will be constructed on two floors in Javits to accommodate the USAO during the renovation of Mollo and, at the conclusion of this project, will be reused to permanently house a portion of the USAO currently housed in leased space (Phase III). This Notice is advertised for the Mollo CMc only (Phase II). The CMc contractor will be selected through a procurement method developed in accordance with FAR Part 15.1 – Source Selection Processes and Techniques. The Government must ensure that there is adequate capability, experience, and competition among the potential pool of responsible contractors. This procurement will be conducted under North American Industry Classification System (NAICS) Code 236220--Commercial and Institutional Building Construction. The Small Business size standard is an average annual sales and receipts for the past three years that are equal to or less than $39,500,000. GSA anticipates the award of a Construction Manager as Constructor (CMc) contract. This award is subject to the availability of funds. The base contract for design phase services will be awarded at a firm-fixed price. The construction phase services option will be awarded as a Guaranteed Maximum Price (GMP). The GMP will be tracked through open book accounting which will be reviewed and monitored by GSA and a third party Construction Manager as Advisor. The period of performance for the proposed contract will be for approximately forty-seven (47) weeks for the CMc design assist phase and approximately one hundred and seventy-eight (178) weeks for the construction phase. The total Estimated Cost of Construction at Award for Phase II is $174,408,816. Notice To Proceed for construction is anticipated to be issued in the Spring 2023. The CMc contractor shall be a member of the project development team during the design and construction phases of the project, working with the Government's selected Architect/Engineer (A/E) and the Government representatives to ensure a quality project, within the mandated schedule and budget. The CMc contractor will perform services including, but not limited to: evaluating design concepts, monitoring A/E progress, coordinating design reviews, reviewing designs, reviewing and preparing cost estimates, controlling schedules, keeping records, reporting on design and construction progress, conducting Value Engineering exercises, coordinating with local agencies (such as the New York City Department of Transportation, New York City Department of Buildings , New York City Department of Parks and Recreation and the Metropolitan Transportation Authority), conducting constructability reviews, constructing the facility, administering the construction contract and all subcontracts, coordinating construction meetings, Critical Path Method scheduling, monitoring construction costs, and performing administrative and other services as defined in the scope of work to provide for a completely functional facility. If you are an interested general contractor or a firm who has experience acting in the capacity of a CMc contractor, you are invited to submit a written Letter of Interest to include a Capability Statement addressing the following information (five page limit). All information submitted is subject to verification. Additional information may be requested to substantiate responses. The Government will use this information to assess the likelihood of your firm’s capability to perform this project. 1) Name of your company, DUNS (www.dnb.com), address, point of contact with phone number and email address. 2) Business size for the assigned NAICS code, which can be located at the Small Business Administration (SBA) website; www.sba.gov. In addition to the size of business, indicate any other socioeconomic designations such as 8(a), Small Disadvantaged Business, HUBZone Small Business, Service-Disabled Veteran-Owned Small Business, and/or Women-Owned Small Business. 3) Company's capability to perform a contract of this magnitude and complexity by including a brief description of at least three (3) similar whole building renovation/ modernization projects of similar size and complexity completed within the past ten (10) years, including project delivery method utilized for each project, customer names and phone numbers, timeliness of performance, and dollar values of the projects. 4) State your company's bonding capability. 5) If your company is/will be part of a joint venture, state the name(s) of the joint venture members and the business size(s) of each. 6) State if your company is in compliance with Cost Accounting Standards, per FAR Part 30.
