The US Environmental Protection Agency (EPA) intends to negotiate, on a sole source basis, with ChemAxon, LLC (ChemAxon), a firm fixed-price purchase order under Federal Acquisition Regulation (FAR) Part 13 Simplified Acquisition Procedures (SAP) for the purchase of annual software license and renewal fees for Instant JChem Enterprise Network Service and Support Maintenance Renewal, for EPA's Office of Chemical Safety and Pollution Prevention (OCSPP), located in Washington, DC. The purchased license(s) will allow for the use of ChemAxon's proprietary software for the term of 1 year with the option to extend the purchase order for an additional two 1-year periods of performance. The EPA's Office of Chemical Safety and Pollution Prevention (OCSPP) requires a complete set of desktop software that houses the functionality of other Chemaxon tools including: Document to Structure (Qty-2), Instant JChem Enterprise (Qty-70), JChem for Office (Qty-2), JChem Web Services (Qty-70), Standardizer (Qty-2) and Structure Checker –(2). Instant JChem allows EPA chemists and biologists to create, manage and analyze hundreds of thousands of chemical structures in a database-conducive environment. It is also a platform on which other chemistry applications can be built. Instant JChem allows EPA end user scientists to easily create, connect and share local databases, and also connect to external ones. Structure files can be imported, exported and merged, their data tabulated, sorted and queried. There is support for 2D and 3D structure display, and relational data. EPA scientists can build or apply their own chemical business rules; the tool also allows for third-party functionality to be integrated. ChemAxon's proprietary software, which is presently in use by the EPA OCSPP scientists, is the only software currently compatible with OCSPP's customized database. For these reasons, it is believed that ChemAxon software is uniquely qualified and capable of meeting the needs of the OCSPP scientists. This purchase order is therefore being directed, without competition, to ChemAxon. The circumstances permitting Other than Full and Open Competition at this time is FAR 13.106-1(b) Soliciting from a single source, only one responsible source and no other supplies or service will satisfy agency requirements. ChemAxon shall provide all necessary support with the Instant JChem software suite licenses. The support will be provided by email, phone and their website. The support shall also include all software patch updates and upgrades for the life of the product. The intent of this synopsis is to state the Government's intention to sole source this acquisition and to determine if any other source(s) exist; and, therefore, no solicitation (RFQ) is available. All interested parties who believe they can provide the required service should 1) fully explain their capabilities and qualifications in writing and submit same via FedConnect, a government web portal, within 15 days from the date of this announcement; and 2) must submit itemized pricing, in US dollars, that is sufficient to decide that competition is feasible. Consequently, any responder(s) failing to provide the aforementioned data but instead choosing merely to submit a routine letter requesting a copy of the RFQ will not be honored.
