UNITED STATES ENVIRONMENTAL PROTECTION AGENCY Cincinnati, OH 45268 Pre Solicitation Notice SOL 68HERC23R0016 Health and Environmental Risk Assessment (HERA) The solicitation 68HERC23R0016 will be available for downloading at FedConnect® located at the following internet address: www.fedconnect.net/. Questions relating to the solicitation are required to be submitted electronically through FedConnect®. ONLY those questions posted through FedConnect® will be accepted. All responses to questions will be released on FedConnect®. At this Internet site you will be able to register with FedConnect®, enabling you to download the solicitation once released, join the mailing list, and to submit questions. Contractor registration in the Government’s System for Award Management (SAM) is required in order to be eligible for contract award. Registration may be completed and information regarding the registration process may be obtained at http://www.sam.gov. Once issued, solicitation documents will be available electronically for download at https://www.fedconnect.net. Hard copies of the solicitation package will not be distributed. Electronic copies of responses will be required and must be submitted via FedConnect® (https://www.fedconnect.net). The US Environmental Protection Agency, Office of Research and Development (ORD), National Center for Environmental Assessment (NCEA) has a requirement for technical support services for offices located in Washington D.C., Cincinnati, OH, and Research Triangle Park, NC. The Contractor will provide Technical Support for Health and Environmental Risk Assessment methods, assessment products and guidance. The contractor will also provide support for related activities and research to improve the science of ecological risk assessment. The solicitation shall contain the custom local provision Disclosure Requirements for Organizational Conflicts of Interest (EPA-L-09-102) Paragraphs (a) and (c) of the clause shall provide as follows: (a) The proposed contract requires that the contractor provide technical support services to the Office of Research and Development’s (ORD), National Center for Environmental Assessment (NCEA) relative to the development of human health risk assessment, methods, and guidance. Based on the nature of the PWS requirements, the contractor must be capable of providing unbiased results. An offeror shall specifically disclose whether it or any of its parent, subsidiary, affiliate, or sister companies is one of the following entities or has any significant business or financial relationships with such entities. Offerors are required to disclose the extent of those business or financial relationships in their proposals, and they shall describe how any actual or potential organizational conflicts of interests associated with such entities can be mitigated, neutralized, or avoided. Affected entities are as follows: • Chemical producers/importer/manufacturers, such as pesticides and agricultural product producers/importers, and waste management/waste disposal entities, entities in the dry cleaning or paper industry, entities in the automobile industry or any other manufacturing or processing operation that uses significant quantities of chemical substances which could potentially contaminate water bodies, air, and/or land. • Entities which manufacture or sell water treatment equipment, air monitoring equipment, (filters, catalyst etc.) and/or flood analysis equipment. • Entities that have or have significant clients that have, a financial interest in issues or outcomes of EPA decisions supported by work under the contract such as a contractor having as a client an industry trade association which has an interest in the Agency decisions supported by work under the contract. • A contractor who has as a client an industrial discharger that would be subject to effluent guidelines limitations, air monitoring guidelines, pesticides guidelines and standards that EPA is developing based on the contractor’s technical support for human health and exposure risk assessments. • In addition, a potential OCOI could exist with firms that provide consulting and/or technical services with respect to waste water discharges, combustion discharges from incinerators and other sources, and superfund waste dumpsites regarding air water quality. • A potential OCOI could also exist with firms that provide consulting and/or technical services to drinking water plants, air quality management services, or food quality management services. • Furthermore, a potential OCOI would exist if the contractor acts in a consulting, advisory, or legal capacity with, or for, entities trying to challenge, overturn or circumvent EPA regulations and/or other actions (e.g., enforcement, remediation, monitoring) which are supported by assessment products or chemical hazard assessments developed under this contract. (c) The Agency has determined that offerors with business, financial or other interests described in paragraph (a) above (further referred to as "these activities") may have significant potential organizational conflict of interest in relation to the requirements of this solicitation. In addition, a potential organizational conflict of interest may exist with firms that provide consulting and/or technical services related to these activities. The solicitation and resulting contract shall also contain the clause, “Limitation on Future Contracting.” The text of this clause will track with Limitation of Future Contracting, Alternative V (Headquarters Support), EPAAR 1552.209-74 (APR 2004), except for paragraph (c). Paragraph (c) of the clause shall read as follows: “Paragraph c: “The contractor and any subcontractors will be ineligible to enter into business or financial relationships with other non-governmental entities to perform human health risk assessments and develop human health risk assessments methods and guidelines that are the same as or similar to those for which the contractor has provided support to EPA through task orders under this contract. Additionally, the contractor during the life of the contract, and for a period of three years from its completion agrees not to enter into contracts with entities who could be impacted (either positively or negatively) from the content of regulations, criteria, standards, guidelines or policies that result from work that the contractor (or its subcontractors) have performed under this contract, without prior written authorization from the Contracting Officer.” The Government anticipates award of a indefinite delivery/indefinite quantity (ID/IQ) contract that will allow for the issuance of firm fixed price (FFP) and time and material (T&M) type task orders over an ordering period of 7 years. The EPA intends to award a single contract with an ordering ceiling of $75 million. The anticipated solicitation release is in the Late July time frame and the close date shall be approximately 45 days thereafter. The solicitation will be issued on a full and open competitive basis with no small business set-aside(s). A Draft Performance Work Statement (PWS) document shall accompany this Pre solicitation Notice via separate attachment. Be advised that changes to any or all documentation is possible when the final Solicitation (SOL) is released. No hard copies will be available. All responsible sources may submit a proposal for EPA consideration. The applicable NAICS code is 541715 Research and Development in the Physical, Engineering, and Life Sciences (except Nanotechnology and Biotechnology), with a size standard of 1,000 employees.
