The U.S. Environmental Protection Agency (EPA) intends to negotiate on a sole source basis with Elevar Design Group, Inc. (small business), under the authority of FAR Part 6.302-1, for a Firm Fixed Price (FFP) Contract to continue to provide Architect/Engineer (A/E) Follow-On services for the Environmental Protection Agency’s Office of Mission Support (OMS) Seawater Pump Replacement Project at an Office of Research and Development (OMS) laboratory located at Narragansett, RI. Elevar Design Group, Inc. (small business) has been providing follow-on services for the Narragansett Seawater Pump construction project under contract EP-C-17-028 Task Order 68HERC20F0042 which expires June 11, 2023. However, during testing of the new seawater pump system it was discovered the seawater pumps do not have enough capability to lift water out of the bay for use by the ORD laboratory. As a result, Elevar Design Group, Inc. (small business) has issued a change bulletin for a vacuum system to be installed to pull the water all the way up from the bay to the inlet of the centripetal pump. This design change order should correct the issue, but the delivery of the vacuum system and construction changes will not be complete by expiration of the task order on June 11, 2023. Elevar Design Group, Inc. (small business) is the only known A/E firm qualified to provide these follow-on services because they have been intimately involved with the follow-on services since construction began and recently developed a change bulletin with a design for a vacuum system in order for the new installed pumps to prime and pull water out of the bay for the facility. The utilization of a different A/E firm is not in the best interest of the Agency because Elevar Design Group, Inc. (small business) is the Designer of Record and it is necessary for them to remain with the project. Delivery of the vacuum system, installation, and construction changes are scheduled to be complete by October 2023. Therefore, the period of performance for this effort is approximately June 12, 2023 through November 30, 2023 with an estimated value of $45,000. This requirement will utilize FAR Part 6. The North American Industry Classification System (NAICS) code is 541330, Engineering Services with a small business size standard of $25.5 million dollars. Elevar Design Group, Inc. (small business) is the only known contractor to continue to provide the follow-on services due to their unique knowledge and expertise of the project as the Designer of Record and provider of follow-on services for this project. THIS NOTICE IS NOT A REQUEST FOR PROPOSALS. Notwithstanding, any firm that believes it is capable of meeting the EPA’s requirement may submit a capability statement which must address how it will meet requirements identified above. Such documentation must be submitted to the Contracting Officer by 4:30 pm Eastern Time on May 31, 2023. A determination not to compete the proposed FFP contract based upon the responses received to this notice is solely within the discretion of the Government.
