The expert will review the appellant’s expert reports, contract and payment records, and damages calculations; evaluate the opposing expert’s methodology, causation, and recovery assumptions; prepare a written rebuttal report; provide deposition and hearing testimony; and assist with trial, ADR, and VA counsel consultation. The award is justified under expert-services authority based on LitCon’s designated expert’s unique experience in quantifying damages in government contract disputes involving contingency-fee or recovery-based compensation models. The VA expects a six-month period of performance based on prior similar efforts and the nature of the pending litigation.
