Contracting Activity: Department of Veterans Affairs (VA), National Cemetery Administration (NCA) Massachusetts National Cemetery, Off Connery Ave, Bourne MA. 02532. 2. Nature and/or Description of the Action Being Processed: This is a justification and approval for Other Than Full and Open Competition to establish a follow-on contract to supply concrete graveliners. The Contractor shall furnish all labor, supervision, equipment, materials and supplies necessary to provide GL2 concrete grave liners for the Massachusetts National Cemetery. 3. Description of Supplies/Services Required to Meet the Agency s Needs: Wilbert Funeral Services OBA Century Vault Co. has been providing concrete graveliners at at Massachusetts National Cemetery. Wilbert Funeral Services OBA Vault Co. was the previous incumbent that was awarded a base and four, one year options contract. Wilbert Funeral Services OBA Vault Co. shall furnish all labor, equipment, material and transportation (F.O.B. Destination with consignee premises) necessary to install prefabricated concrete graveliners at the Massachusetts National Cemetery, Connery Avenue, Bourne, Massachusetts 02532. Graveliners will be fabricated in strict accordance with Type-I, Style-I (box with separate lid), LINER, GRAVE, CONCRETE). On an annual basis, the Contractor will be required to furnish approximately, 355 graveliners. 4. Statutory Authority Permitting Other than Full and Open Competition: . X (1) Only one responsible source and no other supplies or services will satisfy agency requirements per FAR 6.302-1; . (2) Unusual and compelling urgency per FAR 6.302-2; . (3) Industrial mobilization, engineering, developmental or research capability or expert services per FAR 6.302-3; . (4) International agreement per FAR 6.302-4 . (5) Authorized or required by statute FAR 6.302-5; . (6) National security per FAR 6.302-6; . (7) Public interest per FAR 6.302-7; 5. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Wilbert Funeral Services OBA Century Vault Co. has provided concrete graveliners services at Massachusetts National Cemeteries. Wilbert Funeral Services OBA Century Vault Co. has the necessary capabilities to perform this requirement. Wilbert Funeral Services OBA Century Vault Co.has extensive experience to install prefabricated concrete graveliners at the Massachusetts National Cemetery. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Wilbert Funeral Services OBA Century Vault Co. is a large business vendor that specializes in fabricating and installing concrete graveliners at Massachusetts National Cemetery. Solicitation 36C78623Q0038 was posted on SAM.gov as a set aside to SDVOSB, but only one SDVOSB responded. The quote was significantly over the Government price estimate. Therefore, the rule of two has not been met and the quote received was not fair and reasonably priced. Solicitation 36C78623Q0068 was set aside for tiered evaluations on SAM.gov. Solicitation 36C78623Q0068 resulted in no quotes being received. Any other potential sources would require additional costs to perform services due to the nature of the procurement. Any other potential sources would not be able to hire the necessary staff to perform the grounds maintenance services within the allotted timeframe. Based on these findings, it is the Contracting Officer s determination that this requirement be awarded on a sole source basis to a large business, Wilbert Funeral Services OBA Century Vault Co. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated value of the contracted services is for $1,233,200 for a base and four one, year options. The Contracting Officer has determined the costs to be fair and reasonable based on comparison to Government prepared Independent Government estimate. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by the original synopsis 36C78623Q0038 of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. Only one quote from a Service-Disabled Veteran Owned Small Business was received. The quote was determined not to be fair and reasonable. The rule of two Service Disabled Veteran Owned Small Business(SDVOSB) or Veteran Owned Small Business (VSOB) could not be met. A second synopsis 36C78623Q0068 was posted as a tiered evaluation and no quotes were received in response to the solicitation. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition (PM/CO): No further information. 10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The VA will continue to conduct market research, including interacting with vendors at professional conferences, exhibitions, and trade shows, to identify alternative sources that could be considered for future acquisitions. 12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
