Synopsis Amended 0001 The Department of Veterans Affairs, Program Contracting Activity Central, St. Louis (PCAC) Office, intends to award a sole source commercial purchase order in accordance with FAR Parts 12 & 13. The North America Industry Classification System Code [NAICS] is 541519 Computer Related Services, and the size standard is $30 Million. The government has identified and determined that Myers Information Systems, inc (Myers) is the only source that can satisfy this agency requirement. The requirement is for the successful migration of the ProTrack traffic system (application software and database) from the VA OI&T virtual machine (VM) server to the ILEAD air gapped network server. All responsible sources may submit a response, which if timely received, but not later than 1500 EST January 3, 2023 will be considered by The Department of Veterans Affairs, PCAC St. Louis Office. This synopsis is for notification purposes only and does not constitute a solicitation for bids or proposals. Any company that feels they have items that meet the needs of the Government must submit their technical data (2 pages or less) to support their claim. The information must explain the company's ability to overcome propriety information. The Government does not intend to pay for any information provided under this synopsis. Contracting Activity: Department of Veterans Affairs Veterans Health Administration Procurement Contracting Activity in St. Louis Contracting 1 Jefferson Barracks Dr., Bldg 56 St. Louis, MO 63125 2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The proposed sole source action is for the procurement and install of Protrack Software migration to support the Institute for Learning, Education and Development (ILEAD) formally Employee Education System (EES) Broadcasting Studio in Saint Louis, MO and a Service Level support services that provides preventative maintenance and after-hour support for the satellite distribution workflow for the VAKN (VA Knowledge Network). Protrack is currently in use and is proprietary software currently only being sold via Myers. Myers shall provide resources required to deliver, install, commission, and confirm proper operation of system as identified in the SOW. The government anticipates a fixed-price contract. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The OEM provided a letter (P02_SOLE PROPRIETARY INTEGRATION DEC 12 2022) that states Myers Information Systems, Inc is the sole developer, provider and maintainer of the ProTrack Software System. Furthermore, it goes on to state that Myers Information System is the only qualified provider for Protrack Updates, professional services and technical support. As such, this limits availability of the required service to only one source. They also state that they do not have a dealer network. This identifies that there are no other vendors capable of providing the required services to be used for this migration. Implemented by FAR 13.106-1. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). 4. Description of market research conducted and results or statement why it was not conducted: ILEAD contacted the OEM to determine if they allowed other vendors to provide the required services for this migration This market research attempt resulted in the OEM POC providing a letter (P02_SOLE PROPRIETARY INTEGRATION DEC 12 2022) that states Myers is the OEM of the equipment/system to be maintained and that Myers is the only authorized provider of support service. Furthermore, the letter states that Myers does not have a dealer network, and as such no other vendor is available to provide the required services. Without the proper system migration, the ProTrack system would not be able to function and would cause an interruption in service, rendering ILEAD unable to continue the required 24/7/365 content delivery channels that support the VHA s healthcare providers with an employee education platform for those serving our nation s Veterans.
