Purchase of Vyaire name brand Pulmonary Function Testing (PFT) equipment for Veteran Integrated Services Network (VISN) 23. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This is a solicitation conducted using FAR Part 13 (Simplified Acquisition Procedures). This announcement constitutes the only solicitation, quotes are being requested. Solicitation number 36C26323Q0800 is issued as a request for quotes (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2019-02. This procurement is a name-brand-only full and open competition. Prospective offerors must be registered and current in the System for Award Management (SAM) database at time of offer to the Government (https://www.sam.gov). Quotes will only be accepted from responsible contractors. The NAICS code for the solicitation is 339112 with a size standard of 1,500 employees. A list of the contract line items, quantities, and units of measure are listed within the attached solicitation documentation. The VA anticipates one firm fixed price contract award to provide the equipment VISN23 with a delivery date of 90 days ARO. FAR provisions 52.212-1, 52.212-2, and 52.212-3 apply to this procurement and are detailed within the attached solicitation document. FAR clauses 52.212-4 and 52.212-5 apply to this procurement and are included within the attached solicitation document. Additional requirements are listed within the attached solicitation document. The Defense Priorities and Allocations System (DPAS) does not apply to this acquisition. Quotes are due to the Contracting Office by 08:00am CT, 09-11-2023. This Notice of Intent is for a proposed award of a sole source, firm-fixed price contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) - Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements. It is not a request for competitive quotes. The Department of Veterans Affairs, Network Contracting Office 23 intends to award a sole source, firm-fixed price contract to Trillamed LLC for Vyaire name brand Pulmonary Function Test and Spirometry Equipment to replace aging equipment in the Veteran Integrated System Network (VISN) 23 region of medical facilities. VA requires the proprietary equipment from Trillamed LLC as the only authorized third party wholesale distributer for Vyaire in the VISN23 region in accordance with 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) - Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements because the equipment is unique and/or proprietary to Vyaire. Market research revealed that Trillamed LLC is the only authorized third party wholesale distributer of Vyaire s proprietary equipment which is currently being utilized by VA. The PFT and Spirometry system is routinely used by VA to provide medical services for veterans in the VA Healthcare System. The North American Industry Classification System (NAICS) code for this requirement is 423450 and the service code is 6515. While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy the requirement. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The Government understands that Trillamed LLC is the only vendor that can provide the requested services. However, vendors that believe they can provide the capabilities required to fully meet the Government's requirement may submit information in writing to curt.larose@va.gov within ten calendar days after publication of this notice. Such documentation will be reviewed solely for the purpose of determining whether or not to conduct the procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
