THIS IS A NOTICE FOR AN EXCEPTION TO FAIR OPPORTUNITY Network Contracting Office 23 is posting an exception to fair opportunity in accordance with FAR 16.505(b)(4)(D)(i)(ii)(2) The emergency task order will provide construction period services to create an Acute Respiratory Clinic-Isolation for Covid-19 Veterans. A determination by the Government not to compete this emergency requirement is solely within the discretion of the Government. The statutory authority permitting an exception for fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505 Subpart 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays and additional damage to Government property. The J&A is attached THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued.
