Network Contracting Office 23 intends to award an emergency sole source contract to DAX-GBAB Construction Company., Smithville, Missouri for the Minneapolis VA Health Care System, Minneapolis, Minnesota. The requirement was competed but an error while abstracting occurred. This resulted in an incorrect determination for successful Offeror. There is not enough time to recompete this project among the MATOC holders. NAICS code is 236220, Commercial and institutional building construction. A determination by the Government not to compete this emergency requirement is solely within the discretion of the Government. The statutory authority permitting an exception for fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505 Subpart 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
