Network Contracting Office 23 intends to award an emergency sole source contract to Preferred Electric Inc., Minneapolis, Minnesota for the Minneapolis VA Health Care System, Minneapolis, Minnesota. The emergency requirement will provide restoration services for water damage on the 4th, 3rd, and 2nd floors of building 70. NAICS code is 238390, Other building finishing contractors. A determination by the Government not to compete this emergency requirement is solely within the discretion of the Government. The statutory authority permitting an exception for fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505 Subpart 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
