This is a sources sought/proof of capability solicitation looking for SDVOSB, VOSB and small business vendors to perform the services per the PWS for market research purposes. Contract Name: Wastewater Sampling, Analysis and Reporting STATEMENT OF WORK (SOW) 1) Scope The Saint Cloud Veterans Affairs Health Care System (STC VAHCS) located at 4801 Veterans Drive, Saint Cloud, MN, 56303 has a need for a contractor to provide wastewater sampling, analysis and reports. The contractor must possess the necessary technical expertise and resources required in order to be considered for award. Services needed include: A. On a quarterly basis, collect 24-hour composite wastewater samples on a weekday selected by the VA at the discharge point, Manhole #37. Samples will be collected over a 24-hour period using and ISCO sequential wastewater sampler. The ISCO sampler must collect four discrete samples at fifteen-minute intervals and combine these discrete samples into one of 24 laboratory-cleaned, one-liter plastic bottles. To achieve a 24-hour composite sample, the hourly composite samples should then be manually combined. The 24-hour composite sample should be thoroughly homogenized, place in laboratory containers, transported to the laboratory under refrigerated conditions using chain of custody procedures. B. The wastewater samples from Manhole #37 need to be submitted to a laboratory for and analyzed for the presence and concentration: total suspended solids, arsenic cadmium total chromium copper total cyanide lead mercury molybdenum nickel total phosphorus selenium silver zinc pH carbonaceous biological oxygen demand chemical oxygen demand oil and grease. Laboratory analysis must be performed using United States Environmental Protection Agency or other recognized standard procedures and all quality control guidelines must be met. Specific information regarding standard operating procedure, detection limits and quality control measures must be made available upon VA request. C. A report must be provided to the VA after each sampling event. The report must include the sampling period dates, times, monitoring discharge points, methods used and parameters analyzed for presence and concentration. Actual analytical laboratory results and chain of custody forms must be attached to the report. D. One permit renewal monitoring event is anticipated during the period of performance. The permit renewal event will require a monitoring event separate from the quarterly monitoring event. In addition to the services to be performed for quarterly monitoring events the permit renewal monitoring event will require laboratory analysis and reporting the presence and concentration of total toxic organics. E. Technical expertise to complete the services required. F. All labor and equipment to perform the services required. G. Electronic record keeping and reporting capabilities. 2) Performance Period Services shall be provided during the base period October 1, 2020 through September 30, 2021, with four (4) optional year renewals for the periods October 1, 2021 through September 30, 2022, October 1, 2022 through September 30, 2023, October 1, 2023 through September 30, 2024, and October 1, 2024 through September 30, 2025. 3) Work Hours Services shall be performed during regular business hours of 8:00 am and 4:30 pm, Monday through Friday, excluding Federal Holidays. Any service performed outside of regular working hours shall be approved in advance by the Contracting Officer s Representative (COR). Federal Holidays observed by the VA include: New Year s Day Martin Luther King Day President's Day Memorial Day Independence Day Labor Day Columbus Day Veterans Day Thanksgiving Day Christmas Day 4) Certifications and Regulatory Compliance The Contractor shall maintain all applicable certifications for services provided and comply with all applicable federal, state, municipal and local laws, rules, and regulations. The Contractor will obtain and maintain any additional certifications that may be required because of changes in regulations. This includes compliance with all Occupational Safety and Health Administration (OSHA), Environmental Protection Agency (EPA), Minnesota Pollution Control Agency (MPCA), The Joint Commission (TJC), Minnesota Department of Health (MDH) requirements and requirements in other States applicable to the services to be performed. 5) Records and Reports The Contractor shall use electronic means for submittal of records and reports to the maximum extent practicable. 6) Laboratory Analysis Contractor shall provide the COR with a list of laboratories that will be used in conjunction with this contract. This list must include the name of the company, address, city, and state, zip code, telephone number, and applicable certifications and standards of practice. 7) Safety The Contractor shall take such safety precautions as the CO or COR may determine to be reasonably necessary. The CO or his/her designee will notify the Contractor of any noncompliance. The Contractor shall, after receipt of such notice, immediately correct the conditions to which attention has been directed. Such notice, when served in person on the Contractor or his/her representative at the site of work, or telephonically to Contractor s designated representative, shall be deemed sufficient for the purpose of the previously mentioned. If the Contractor fails or refuses to comply promptly to satisfactorily abate the hazardous condition or situation, the CO may issue an order stopping all or any part of the work and hold the Contractor in material breach of this contract. 8) Work Practices and Standards The Contractor shall have established standard operating procedures that will be followed while conducting services required. This includes site safety procedures, operational procedures, use and maintenance of supplies and equipment procedures, sampling procedures, and a quality assurance plan. 9) Quality Assurance The Contractor shall maintain a quality assurance program to assure services are performed in accordance with commonly accepted practices. The Contractor shall implement procedures to identify, prevent, and ensure non-recurrence of defective services. At a minimum, the Contractor shall develop quality control procedures addressing the areas identified in the next paragraph. Timely performance of services required. Timely and properly completed reports. Sufficient competent personnel to provide the services required. Sufficient equipment and supplies in good working condition. Fully functional electronic record keeping and reporting system. Timely and accurate billing system. The government will periodically evaluate the contractor performance by appointing a representative(s) to monitor performance to ensure services are received. The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate. Likewise, the government may decrease the number of quality control inspections if performance dictates. 10) Competent Personnel Contractor personnel who perform services for the STC VAHCS must be competent, experienced, and qualified to perform such services. All work shall be performed in accordance with established wastewater sampling and analysis practices. The Contractor shall furnish and ensure all personal protective equipment (PPE) for Contractor employees is in good condition. The Contractor shall provide employee training on established policies and procedures for wastewater sampling and analysis. The Contractor shall submit proof of appropriate training and experience to the COR upon request. 11) Identification, Dress, and Smoking Regulations Contractor employees shall wear visible contractor identification at all times while on the STC VAHCS premises. Dress shall consist of uniforms, khakis, or similar clothing along with work shoes. Veterans Affairs is a smoke free environment. Possession of weapons or contraband is prohibited. 12) Indemnification It shall be expressly agreed and understood by the Contractor and the STC VAHCS that the Contractor agrees to indemnify the STC VAHCS against all liabilities, claims, penalties, incident of death, bodily injuries, destruction or damage to property, contamination or adverse effects on the environment or any violation of government laws, rules or regulations, caused in whole or part by the Contractor s breach of any term of the contract or any negligent or willful act or omission of the Contractor, its employees or subcontractors in the performance of this contract. 13) Penalties and Fines The Contractor shall satisfy all applicable regulatory agency requirements. In the event a regulatory agency assesses a monetary fine against the STC VAHCS for violations caused by the Contractor, the contractor shall reimburse the STC VAHCS for the amount of the fine. 14) Authorized Services Only the services specified in the SOW will be authorized under the contract. The CO in consultation with the COR may authorize additional services under a separate purchase authorization. Reimbursement will not be made unless prior authorization is obtained. 15) Invoices and Payment Payment of services rendered under this contract will be made in arrears upon satisfactory completion of each service and receipt of a properly prepared invoice. Invoices shall reference the contract number, purchase order number, and a complete and accurate description of services including dates of performance, amounts, unit prices, extended totals and any other data relevant for payment purposes.
