Nature and/or Description of the Action Being Processed: This Individual Justification and Approval (J&A) authorizes the use of a construction contractor without competition for an emergency water main replacement at the Fort Meade Veterans Administration Medical Center (VAMC), Fort Meade, SD. This action will be awarded as a new Firm-Fixed-Price contract. Description of Supplies/Services Required to Meet the Agency s Needs: Project Number 568-19-115, Emergency Water Main Replacement, requires the replacement of a failed pipe that services the Fort Meade VAMC. This pipe connects to one of two water mains that provide water to the residents, staff, and veterans at the Fort Meade VAMC. The Contractor identified for this emergency acquisition is Pederson Excavating, Inc., 3425 N Fairgrounds Loop, Ste B, Spearfish, SD 57783 (605) 642-3658. The estimated cost for the entire project is $479,498.00 with an estimated completion date of 30 calendar days after the Notice-To-Proceed is issued. Statutory Authority Permitting Other than Full and Open Competition: ( x ) (2) 41 U.S.C. 3304(a)(2) as implemented by FAR 6.302-2, Unusual and Compelling Urgency Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The repair of the water main is essential and must be completed immediately to prevent the disruption of veterans health care services at the Fort Meade VAMC. Additionally, over 60,000 gallons of water are being lost daily due to the break. This work requirement is urgent as the redundant pipe that is currently supplying the water is approximately 60 years old and could fail as well. If water becomes unavailable to the Fort Meade VAMC, the facility would be unable to provide all services to veterans at the campus and patient safety would be negativity impacted. Without a water source to the hospital, most medical services cannot be provided as water is essential to maintain the sanitation requirements of a medical facility. Pedersen Excavation, Inc. is familiar with the campus, has specialized experience in excavation at the location, and can begin work immediately which is critical for this project. Since this is an urgent and compelling requirement and patient safety could be negatively impacted, acquisition competition requirements must be waived. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the urgency and potential negative impact to the hospital and patient safety, work must begin immediately and a sole-source acquisition is required. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: A detailed Independent Government Cost Estimate (IGCE) has been provided that includes all costs associated with this project, including equipment. The IGCE was created using the 2016 RS Means Construction Cost Data with yearly inflation factors. The contract price will be determined fair and reasonable by the Contracting Office prior to award. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was completed to determine a vendor that could complete this work. The Engineering and Contracting Departments used the acquisition history of previous excavation services at the Fort Meade location to determine potential sources for this service. A Vendor Information Pages (VIP) search was completed to ensure the vendor is a current SDVOSB. Any Other Facts Supporting the Use of Other than Full and Open Competition: This vendor is currently listed as a certified Service-Disabled Veteran-Owned Small Business in VIP and the use of this vendor further supports NCO 23 socio-economic goals for SDVOSB awards. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No other vendors have expressed an interest in this requirement. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: In future acquisitions for non-emergency plumbing requirements, the requirement will be solicited to qualified vendors.
