Contractor shall Install 9 Heating Hot Water Closed Loop Filtration units in the 5 mechanical space we have throughout the VA Medical Center. Contractor shall follow all manufacturer recommendation or as established by the VA standards when it comes to the heating hot water closed loop systems. This shall include all specifications in max and minimum flow rates, necessary temperatures that is used for the comfort heating of all spaces, being able to withstand temperatures and pressures that is specified for each system as well as meeting all VHA Directives in the safety and material guidelines in the installation of each filtration system. Contractor shall provide all labor, tools, supervision, confined space, Lockout Tag outs, Hot Work Permits and equipment necessary to complete this project. Contractor will be responsible for the maintenance and repair of the completed system for a period of one calendar year. Contractor will include any spare parts such as (1) filter canister and 9 replacement filter bags for each unit. There will be no option years applied to this turnkey install after completion of install, maintenance, repairs and monitoring of the equipment. All the associated equipment s are in the Central Energy Plant Building # 2 as well as the Main VA Medical Center Facility located at 6900 North Pecos, North Las Vegas, Nevada. The period of performance for this contract is as follows: ******************************************************************************* This solicitation is for a period of performance that will consist of full install and maintaining installed system for a period that will mitigate any issues after system has been fully commissioned. Performance period starts after the last system is fully installed and online: SPECIFIC REQUIREMENTS. (VA Medical Center Heating Hot Water System Filtration and Treatment) Contractor will perform the following requirements: Installation Details: Install a total of (9) Pot feeder/chemical treatment units in the mechanical spaces and boiler room Install and reconfigure proper piping using forged steel schedule 80 as well as high temperature rated valving that is consistent with VHA Directive from the Master Specifications on Steam and Heating Hot water specifications. Install gauges that will determine delta P across the filter to properly track and maintain filter cleaning schedule. Test all connections at full pressure to make sure no leaks of any kind are detected. System piping and components shall be tested with a pressure of not less than one and one-half times the operating pressure but not less than 100 psi (689 kPa). Piping shall be tested with water or air. Test pressures shall be held for a period of not less than 30 minutes with no perceptible drop in pressure. These tests shall be made in the presence of the COR/Contracting Officers Representative. The installation shall be in conformance with the most current editions of plumbing codes such as the National Standards Plumbing Codes (NSPC) Contractor is to install flow directional symbols to show path of heating hot water. Replace or install pipe insulation to prevent heat loss as well as protecting personnel from burns including pipe coverings and linings, shall have a flame-spread index not to exceed 25 and a smoke-developed index not to exceed 50 were tested in accordance with ASTM E84 or UL 723. Install drain lines that will or can be drained to the closest floor sinks for each filter. Use only schedule 80 piping for drain lines. The installation shall include all necessary components as described in this specification and any additional details not included in this specification that are necessary for properly completing the work. All new units to be sized by Contractor to meet the existing heating load demand. Each filter shall be set or mounted on a level base capable of supporting and distributing the weight contained thereon shall be securely anchored to the structure. All filter canisters should be constructed in accordance with ASME Pressure vessel Code. Installation Requirements: Immediately upon contract execution, Contractor shall address all requirements for completing background checks and badging of all subcontractors and personnel that will plan to be working in all the Mechanical Rooms of the VA Medical Center site. Badging can be scheduled through the VA Police and Engineering Department/FMS. Contractor will follow lock out tagout techniques when working on any pressurized systems. Contractor will be transparent with COR/Contracting Officers Representative while working on this system. Replace any chemicals that was lost due to re-piping of the system. Contractor will make sure the area of work is cleaned and void of any materials that will cause fall and slip hazards. Contractor will utilize job boxes to store tools parts or materials during this contract work to prevent misplacement of materials that is being used by the contractor. Contractor will notify all maintenance staff of any system shutdowns that is necessary for install to not disrupt or impact patient care. Contractor s salvage plan must meet all applicable EPA requirements. Contractor shall have complete environmental responsibility for disposal of the existing units in accordance with current environmental laws. Contractor will test and report all heating hot water system Nitrite levels before and after install Contractor will turn over any documents, manuals or operational maintenance procedures recommended by manufacturer. HOURS OF WORK AND SCHEDULING: Work shall be scheduled accordingly with the Plant Supervisor during normal hours (Monday to Friday, from 7:30am to 4pm). Work in Building #2 Central Energy Plant and the VA Hospital after duty hours will be coordinated with the Energy Plant Utility Operators after 4pm daily, 7 days a week. Place of Performance: Department of Veteran Affairs Medical Center Central Energy Plant Bldg. #2 6900 North Pecos Road North Las Vegas, NV 89086 COMPLETION TIMELINE: All work must be completed within 30 days of the coordinated date. QUALIFICATIONS: All work for the duration of the contract shall be performed by qualified, certified, and licensed personnel on the system. The Contractor must maintain a service organization within a 50-mile radius from the Veteran s Hospital. CONFIRMATION OF REPAIR WORK: All services will be confirmed and approved by the Energy Plant Supervisor or his/her designee. When service is completed, the certified technician must indicate on the service ticket the equipment serviced, specific action taken, and all parts replaced. The equipment serviced must be identified clearly by name, serial number, and location. COMPLIANCE: The contractor shall be fully responsible for compliance with all VA, local, state, and Federal environmental/occupational safety laws, rules and regulations. The contractor shall follow life and safety codes and take necessary actions to avoid conditions that may be hazardous to the health and safety of hospital personnel and patients. The contractor is responsible for meeting all applicable OSHA and VA guidelines for safe working processes; example: lock-out/tag-out. All work for the duration of the contract shall be performed by certified trained technicians. CONTRACTOR EMPLOYEES: The Contractor shall assign a Point of Contact (POC) for the purpose of ensuring compliance with all provisions of this contract. The Contractor POC shall be available on site and can address performance issues. All employees should be able to read and speak English. The parties agree that Contractor personnel working under this contract shall not be considered VA employees for any purpose and shall be considered employees of the Contractor. All Contractor personnel assigned to the performance of this contract shall wear a Contractor-provided uniform or ID that clearly identifies the individual as a Contractor. All Contractor personnel are required to wear identification (I.D.) badges during the entire time they are on the VA Healthcare System grounds. I.D. badges must have picture identification, name of the individual, and the represented company depicted on it. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. Example: wearing of distinctive clothing such as uniform, badges, patches, etc. Contractor personnel shall not wear sandals, flip-flop style footwear, or open-toe shoes and shall follow VA dress guidelines. A copy of this will be provided upon request. The Contractor shall ensure that the staff assigned shall be cognizant of the VA s sexual harassment and drug-free workplace policies. The Contractor may obtain a copy of this information from the COR or Contracting Officer. ESCORT AND VETERAN S HOSPITAL SECURITY POLICE CHECK-IN: All contractor personnel working onsite at the VA facility shall check in and out with VA Police dispatch located in the administrative building #6 south entrance. Access to work areas, and performance monitoring, will be provided by VA Engineering Service personnel. After-hours work will be monitored by VA Central Energy Plant Operators, 702-791-9000 Ext 16900. In all cases, the VA Central Energy Plant Operator shall be notified of any changes which may affect the response time of vital equipment. AUTHORIZED SERVICE: Only those services specified within are authorized under this contract. Before permitting any service or repairs of a non-contract nature, the Contracting Officer must be advised of the reasons for this additional work. The Contractor is cautioned that only the Contracting Officer or his/her designee may authorize additional service or repairs that are outside of the scope of this contract and that reimbursement shall not be made unless prior authorization is obtained. TEST EQUIPMENT: The VA shall not furnish parts and/or test equipment for the performance of this contract. It is the responsibility of the contractor to have/bring the appropriate equipment and/or supplies necessary to complete the work. CONTRACTOR CONTACT INFORMATION: The Contractor shall provide in the space below the name, address, and telephone number of the office where service calls are to be placed: NAME: ADDRESS: TELEPHONE NUMBER: FAX NUMBER CONTRACTING OFFICER REPRESENTATIVE (COR): The Contractor shall not accept any instructions issued by any other person(s) other than the Contracting Officer. The Government may appoint a COR. If so, a Delegation of Authority letter shall be forwarded to the using service and the Contractor after the contract has been signed, identifying the individual(s) as the COR(s). CHANGES: The Contractor is advised that only the Contracting Officer, acting within the scope of the contract has the authority to make changes which affect the contract in terms of quality, quantity, price or delivery. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment shall be made in the contract price to cover any increase in costs incurred as a result thereof. PERSONNEL REQUIREMENTS: The Government reserves the right to accept or reject Contractor s staff for the rendering of services. Complaints concerning Contract Personnel performance or conduct shall be dealt with by the Contractor, and/or the COR with the final decision made by the Contracting Officer. PERSONNEL QUALIFICATIONS/EXPERIENCE CRITERIA: Contractor personnel shall have the following qualifications, but not limited to: The contractor shall provide a Lead Technician to oversee all contract personnel with documented experience implementing large scale projects equal to, or greater than, the scope of this project. CONTRACTOR S RESPONSIBILITIES: The Contractor shall maintain personal liability and property damage insurance prescribed by the laws of the Federal Government. He/she shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, or others, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by him/her or his/her employees fault or negligence. Contractor shall comply with all VA safety standards, manufacturers/industry standards, FDA, OSHA, JCAHO and the latest edition of NFPA-99. CONTRACTOR SUBMITTALS/INSURANCE REQUIREMENTS: The Contractor is required to comply with Federal and State Workers Compensation and liability insurance (Reference FAR clause 52.228-5-Insurance and Subpart 28.307-2-Liability). The Government shall be held harmless against any or all loss, cost, damage, claim expense or liability whatsoever, because of accident or injury to persons or property of others occurring in the performance of this contract. The Contractor shall be responsible for all damages to property, which may be done by him/her or any employee engaged in the performance of this contract. The parties agree that the Contractor s personnel working as a result of this contract shall not be considered VA employees for any purpose and shall be considered employees of the Contractor. The Contractor shall be responsible for providing: a. Workers Compensation. b. Professional liability insurance. c. Health examinations. d. Income tax withholding, and, e. Social Security payments. SMOKING POLICY: Smoking is not permitted within or around the VA, except in designated areas. SAFETY AND FIRE PREVENTION: In the performance of this contact, the Contractor shall take such safety precautions as necessary to protect the lives and health of the occupants of the building. Fire and safety deficiencies, which exist and are part of the responsibility of the Contractor, shall be immediately corrected. If the Contractor fails or refuses to correct deficiencies promptly, the COR may issue an order stopping all, or any part, of the work. The Contractor shall comply with applicable Federal, State, and local safety and fire regulations and codes, which are in effect during the performance period of the contract. The Contractor personnel shall follow applicable facility policies concerning fire/disaster programs. VA POLICY: Possession of weapons is prohibited. Enclosed containers, including tool kits, are subject to search. Violations of VA regulations may result in citations answerable in the United States (Federal) District Court. BADGES AND PARKING: It is the responsibility of Contractor personnel to park only in designated parking areas. Parking information is available from the VA Police. The VA will not validate or make reimbursement for parking violations of the Contractor s personnel under any circumstances. HOURS OF SERVICES: The Contractor shall perform the onsite services Monday through Friday with the exception of National Holidays (see below) between the hours of 7:30am to 4pm. OVERTIME AND HOLIDAYS: Any overtime and/or holiday pay that the Contractor s employees may be entitled to, shall be the sole responsibility of the Contractor and shall not be billed to nor reimbursed by the Government. NATIONAL HOLIDAYS The contractor is not required to provide service on the following National holidays, nor will the Contractor be paid for these holidays. RECORD MANAGEMENT: Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. Chapters. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation. In accordance with 36 CFR 1222.32, the contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data. The VA Southern Nevada Healthcare System (VASNHS) and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of VASNHS or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, the contractor must report to VASNHS. The agency must report promptly to NARA in accordance with 36 CFR 1230. The contractor shall immediately notify the appropriate Contracting Officer (CO) upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the contract documents. The contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to VASNHS control, or the contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the CO or address prescribed in the contract documents. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4). The contractor is required to obtain the CO's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The contractor (and any sub-contractor) is required to abide by Government and VASNHS guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information. The contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with VASNHS policy. The contractor shall not create or maintain any records containing any non-public VASNHS information that are not specifically tied to or authorized by the contract. The contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the FOIA. VASNHS owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which VASNHS shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20. Training.  All contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training. The contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training. Flow down of requirements to Subcontractors: The contractor shall incorporate the substance of this clause, its terms and requirements including this paragraph, in all subcontracts under this contract document, and require written subcontractor acknowledgment of same. Violation by a subcontractor of any provision set forth in this clause will be attributed to the contractor. 52.223-99 Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors. Compliance. The Contractor shall comply with all guidance, including guidance conveyed through Frequently Asked Questions, as amended during the performance of this contract, for contractor workplace locations published by the Safer Federal Workforce Task Force (Task Force Guidance) at https:/www.saferfederalworkforce.gov/contractors/. Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts at any tier that exceed the simplified acquisition threshold, as defined in Federal Acquisition Regulation 2.101 on the date of subcontract award, and are for services, including construction, performed in whole or in part within the United States or its outlying areas. Contractor employees who work in or travel to VHA locations must comply with the following: Documentation requirements: If fully vaccinated, shall show proof of vaccination NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the following website: COVID-19 Screening Tool. Regularly check the website for updates. Contractor employees who work away from VA locations, but who will have direct patient contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities. For indefinite delivery contracts: Contractor agrees to comply with FAR 52.232-99 and VHA Supplemental Contract Requirements for any task or delivery orders issued prior to this modification when performance has already commenced.
