PERFORMANCE WORK STATEMENT Scope: Pest Control Management The service provider will provide for complete pest control services for the facility locations under the Department of Veterans Affairs Healthcare System as listed in the Location Information Section. The contractor shall be licensed in the state of California where the work is performed and be able to present proof of the licensing. The Integrated Service Provider will provide all necessary equipment, chemicals, and supplies to provide all required services. Period of Performance: 05/01/2022 04/30/2028 Location Information: Department of Veterans Affairs 4150 Clement Street San Francisco, CA 94121 Hours of Operation: The contractor shall perform regular scheduled services on a Monday, Wednesday, and Friday between the hours of 7:00 a.m. to 3:30 p.m., excluding Federal holidays. Federal Holidays: New Year s Day, Martin Luther King Day, President s Day, memorial Day, Independence Day, Labor Day, Columbus Day, Veteran s Day, Thanksgiving Day, Christmas Day, and any other day specifically declared by the President of the United States to be a federal holidays. Tasks and Requirements: 1) Contractor is to furnish all labor, equipment and material to provide pest control services at: Department of Veterans Health Care System San Francisco, 4150 Clement Street San Francisco, CA 94121 Contractor shall utilize pesticides that are of a low volatility and odor free in order to keep levels from affecting patients. Note: No Pest Control Material shall be placed where they may be recovered by patients. No pest control materials shall be allowed to come in contact with food and cooking utensils. 3) Contractor personnel are required to interrupt their work at any time so as not to interfere with normal functioning of the facilities, fire protection systems and passage of facility patients' personnel, equipment and carts. 4) The Contractor shall conform to all applicable Federal, State and local regulations governing examining and licensing of pest control operators, performance of pest control, use of approved pest control chemicals and equipment, which may be in effect in the area in which the work under the contract will be performed. The pesticide, insecticide, baits, or traps used shall comply with regular local standards and it should be harmless to humans. 5) All contractor personnel must always have their name and the company s name visible on their uniforms, so they are easily recognizable. In cases where the contractor has two or more persons reporting for work under the contract, one of these will be designated as a supervisor and must be fully certified in all categories of Pest Management in which work is to be performed. A manager or supervisor from the service provider will meet with a representative of the COR, on a regular basis, to present program effectiveness. Provide periodic progress reports to the COR. Service technicians must be certified by the Cali Department of Agriculture in the categories for the service being rendered. Provide a dependable and courteous staff to meet the needs of the as described in this document. Training programs must be designed, administered, and monitored for effectiveness. On each visit, the applicator(s) shall report to the COR prior to performance on any work. 6.) The Contractor shall not dispose of any excess pesticide containers or any other materials contaminated by pesticides at any location on the VA premises. 7.) Contractor will ensure all safety requirements are followed when servicing the buildings. Prior to servicing the buildings, the contractor is required to submit Safety Data Sheet (SDS) for the pesticide, insecticides, and baits that will be used to the VA Safety Officer to review and approve. Any safety related discrepancies or hazards noted by the contractor when servicing the building and perimeter areas should be corrected immediately and reported to the VA safety officer or COR to ensure that his/her employees take all necessary safety precautions regarding appropriate safety attire (masks, breathing apparatus, clothing, etc.) while performing the services under this contract. 8.) Contractor shall ensure full compliance with all EPA and OSHA rules and regulations when applying pesticide and insecticides inside/outside the buildings. If any of the chemicals spill on the ground/floor during application, the contractor will be responsible for immediate clean up at contractor's expense. 9.) Storage of pest control materials: No pest control materials or equipment shall be stored or left at any VA Installation when the operator is not working. 10.) Call back requirement: The Contractor shall within 4 hours after receipt of notification by the Contracting Officer or COR, and at no additional charge to the Government, retreat previously treated areas when inadequate control (as per specifications) was obtained. 11.) Required contractor reporting: The Contractor is responsible for supplying and completing and submitting all reports required or requested by Federal, State, or local ordinances, which pertain to, any work contained in the contract. In addition to service application logs, specialized documentation will be required for certain services provided. Specific information relative to this additional documentation will be included under various services. All documentation will need to be maintained by the service provider. 12.) The Contractor will be required to furnish the COR, prior to any application of pesticides, SDS and the trade names (if any) and chemical names of the chemicals used and a label showing the contents, the use strength of the chemical as applied and the antidote thereto. 13.) Contractor will furnish SDS each time he changes chemicals or products used in the performance of this contract. This information is required by the VA Medical Service for emergency treatment in the event of ingestion of and/or contact with the material by humans. 14.) Contractors will be always escorted by VA employees to the job site. 15.) Statement of conditions found, and treatment rendered: Following each visit and inspection of a building, the Contractor shall leave a signed and dated notice in writing with the COR or his designee stating the conditions found existing and treatment rendered. . Contractor shall provide monthly pest control treatment at SFVAMC. Contractor shall respond to all emergency calls within 12 hours, a maximum of two per month Quality Assurance Surveillance Plan (QASP) The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality Level (AQL). The COR will evaluate the services required to ensure compliance Task Performance Standard Performance Standard Performance Standard Pest Control IAW Monthly Pest Control Pest management applications IAW the contract 98 % Random Surveillance Rodent Control IAW Rodent Control device emptied and serviced. Must be 99% compliant Random Surveillance Other services provided include but are not limited to: Rodent control, crawling insect control, flying insect control, migratory pest control, bird control and mite control. Specialized pest management applications for standard insecticides, rodenticides, termiticides, thermal fogging s, cold fogging s, avicides, herbicides and fumigants. Service technicians must be certified by the California Department of Agriculture in the categories for the service being rendered. Explain internal quality control monitoring of service work provided. In addition to service application logs, specialized documentation will be required for certain services provided. Specific information relative to this additional documentation will be included under various services. All documentation will need to be maintained by the service provider. No pesticides and/or equipment will be stored on THE OWNER property. Pest company will locate all control devises on a master logistic plant and have a corresponding schedule and log that tracks activity and replacements. All traps will be clearly identified with a self-adhesive sign place at the facility. Rodent Control Rodent bait feeding stations will be deployed throughout the outside areas of the complex. All rodent feeding stations will be secured in a manner acceptable in the pest control industry. A fresh supply of E.P.A. registered rodenticides will be maintained in the rodent feeding stations. All multiple catch traps will be placed according to the manufactures recommendations All multiple catch traps will be placed according to the manufacturer recommendations. All devices will be boldly numbered, and their placement depicted on a map of the facility. This map is to be a part of the customized Rodent Control Report which is to be submitted after each service. The report will document device by device, the activity found. Each control device will be checked, emptied as needed, cleaned, rewound and / or rebated during each service attached to each device will be a service date sticker which the technician will fill in at the time of each service. All devices will be serviced a minimum of 1 time per month. In the event of activity in any of the devices, the technician will determine whether to supplement the existing controls with nap traps and/or glue boards. The technician will inspect the areas near the site of any rodent activity to determine any surrounding infestation and any possible ways of entry. Crawling Insect Control - The technician will use various methods and materials to probe and flush the various insects from their hiding and /or harborage areas. The results obtained from this probing and flushing, along with an inspection of the surrounding area, will dictate any secondary treatment procedures including application of appropriate pesticides, placement of baits, drilling of voids, placement of monitoring devices, etc. All areas will be treated on a once per month frequency. Migratory Pest Control - Appropriate pesticides will be applied around the outside perimeters of all site buildings. The number of these applications may vary with a minimum of three (3) per year. The pesticides will be applied in sufficient quantities to not only effect a kill of existing pests, but also establish a barrier against additional invaders. Flying Insect Control - Services to be administered using either the areas near the site of any rodent activity to determine any surrounding infestation and any possible ways of entry. All areas will be treated on a once per month frequency. Bed Bugs - Services to be administered using either mechanical and/or chemical controls on an as needed basis and at additional cost. A customized Pesticide Application Report will be provided for over or above the normal service ticket. This service must include all areas that are treated, the pesticides used and any findings NARA Records Management Language for Contracts (May 2017): https://www.archives.gov/records-mgmt/handbook/records-mgmt-language.html RECORDS MANAGEMENT OBLIGATIONS A.  Applicability This clause applies to all Contractors whose employees create, work with, or otherwise handle Federal records, as defined in Section B, regardless of the medium in which the record exists.  B.  Definitions Federal Record as defined in 44 U.S.C. § 3301, includes all recorded information, regardless of form or characteristics, made or received by a Federal agency under Federal law or in connection with the transaction of public business and preserved or appropriate for preservation by that agency or its legitimate successor as evidence of the organization, functions, policies, decisions, procedures, operations, or other activities of the United States Government or because of the informational value of data in them.  The term Federal record: 1. includes [Agency] records. 2. does not include personal materials. 3. applies to records created, received, or maintained by Contractors pursuant to their [Agency] contract. 4. may include deliverables and documentation associated with deliverables. C.  Requirements The following standard Items relate to records generated in executing this contract and should be included in a typical contract where records could possibly be created, maintained, or dispositioned: ADD THE FOLLOWING 11 ITEMS TO THE STATEMENT OF WORK (SOW): 1. Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion. 2. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation. 3. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data. 4. [FACILITY] and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of [FACILITY] or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to [FACILITY]. The agency must report promptly to NARA in accordance with 36 CFR 1230. 5. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records, or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to [FACILITY] control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4). 6. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and [FACILITY] guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information. 7. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with [FACILITY] policy. 8. The Contractor shall not create or maintain any records containing any non-public [FACILITY] information that are not specifically tied to or authorized by the contract. 9. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act. 10. The [FACILITY] owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which [FACILITY] shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20. 11. Training.  All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training. [Note: To the extent an agency requires contractors to complete records management training, the agency must provide the training to the contractor.] D.  Flow down of requirements to Subcontractors 1. The Contractor shall incorporate the substance of this clause, its terms and requirements including this paragraph, in all subcontracts under this [contract vehicle], and require written subcontractor acknowledgment of same. 2. Violation by a subcontractor of any provision set forth in this clause will be attributed to the Contractor.
