VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 2: Request for Sole Source Justification Format >SAT OFOC SOP Revision 08 Original Date: 03/22/11 Revision 08 Date: 04/18/2018 Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: Contracting Activity: Department of Veterans Affairs, VISN 21 5342 Dudley Blvd., Bldg. 209 McClellan, CA 95652 Nature and/or Description of the Action Being Processed: This action is to limit the competition for a sole source procurement of Pathology Laboratory Services for VA Northern CA Healthcare System, Mather, CA. The contract action will be a firm fixed price, indefinite delivery indefinite quantity contract. The proposed contractor is the University of California (Davis) U.C. Davis, 2315 Stockton Blvd. Room 2300 Sacramento, CA 95812-2201. FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for Pathology Laboratory Services in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Description of Supplies/Services Required to Meet the Agency s Needs: This requirement is to perform Dermatopathology, Anatomic Pathology and Clinical Pathology laboratory services. Services will include preanalytic processing as defined in Contractor s laboratory user s manual; analysis, reporting of analytic results, and consultation regarding selection, collection, transportation and result interpretation Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only one responsible source FAR 6.302-1 can provide the Dermatology Laboratory Services for the VA Northern CA Health Care System. UC Davis Health System Department of Pathology and Laboratory Medicine has award-winning faculty educators. They have performed over 11 million clinical tests a year in a state-of-the-art clinical laboratory and are recognized experts in the field that review the lab results and provide timely diagnoses. UC Davis uses complement fixation and immunodiffusion. Serial testing is done on patients with titers and this lab can follow the progress of patients on medication. Furthermore, another test performed at UC Davis is Platelet function assay, which only has 4 hours short stability. UC Davis provides a special courier to pick up this specimen. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought was posted to Career Opportunities with two responses received. When asked if their laboratory was within 50 miles of Mather only one responded. A follow up was sent asking them to identify the laboratory and no response was received. Intent to award notice will be posted in accordance with FAR 6.305 (b) Availability of justification. The justification shall be posted within 30 days after contract award. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: An independent government estimate has been prepared and will be compared to the contractor s proposal during the evaluation process, in accordance with FAR 15.805-2(e). A Price Negotiation Memorandum (PNM) will detail how the Government has determined that this acquisition represents a fair and reasonable price. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The eCMS database was researched for any past or existing contracts. The VANCHS has been procuring this service from UC Davis on a sole source basis for several years. After receiving zero responses for the sources sought, it was determined this will be a new contract with the University of California, Davis for Dermatology laboratory services. Market research was conducted in accordance with FAR 10. Any Other Facts Supporting the Use of Other than Full and Open Competition: This section is not applicable. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted prior to exercising any option periods to ensure that there are not any other vendors capable of providing the Dermatology Laboratory Services to the VA Northern CA. -08'00' Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
