VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT Last Updated: 02/01/22 Page 1 of 1 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID:36C260-22-AP-1153 Contracting Activity: Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Roseburg VAMC requires a new pill counter for pharmacy operations. The estimated value of the proposed action is QTY-1 Pill Counter Eyecon Model 9420- OEM Model by Eyecon Required QTY 1- Standard Interface Eyecon software OEM software by ScriptPro required Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Roseburg VA Pharmacy currently uses ScriptPro sowftware at VHA facilities for daily operations and interfacing with existing equipment. Both the equipment and software in this acquistion must work with exsisting automated dispensing cabinets and scriptpro software, which is proprietary to ScriptPro USA, Inc. ScriptPro s GSA contract #36F79719D0135 states the warranty is void if the Equipment or Software has been installed or modified other than as authorized in writing by ScriptPro. ScriptPro is the sole source service provider of the standard interface software required in this acquision. As the OEM, ScriptPro is the only source for new software installs and integration of Pill counter equipment, maintenance/updates, or modifications and upgrades to there systems. Therefore, utilizing or integrating any other software and equipment would cause significant delays and additional funding to integrate with the Roseburg VA Pharmacy s existing ScriptPro software systems. ScriptPro has provided a proprietary letter detailing exclusive rights to the sale and distribution of the standard interface software required in this acquisition. IAW FAR 13.106-1(b)(1)(i), the software required in this acquistion is unique to one developer- Scriptpro USA, Inc. Therefore, this acqusiton will be a brand name only, open market, unrestricted soliciation. Description of market research conducted and results or statement why it was not conducted: Market Research revealed there is only one SDVOSB and the OEM Large Business, ScriptPro, that can provide the Standard Software Interface required in this acquisition. MR identified other businesses that distribute the Eyecon Pill Counter or equipment part of this acquisiton. However, no other businesses can distribute or provide the software standard interface required in this acquisition because it is proprietary to ScriptPro USA Inc.  And, ScirptPro has provided a proprietary letter stating their firm is the sole source service provider of the standard interface software required in this acquision. Consequently, there are insufficient small businesses to pursue a set-aside for small businesses. IAW FAR 13.106-1(b)(1)(i), this procurement will be a brand name only, open market, unrestricted solicitation.
