This request is for informational and planning purposes only and shall not be construed as a solicitation or as an obligation or commitment by the Government at this time. This notice is intended strictly for market research. The purpose of this Sources Sought notice is to determine interest and capability of potential qualifications of Small Businesses, Service Disabled Veteran-Owned Small Businesses, and Veteran-Owned Small Business firms relative to the North American Industry Classification Code (NAICS) 339113 (Surgical Appliance and Supplies Manufacturing). The Department of Veteran s Affairs is seeking small business manufacturer or distributors of small business manufacturers, of functionally equivalent equipment to all the following: 1. Upholstery Top 224/225 28 Seamless Undecided Color XXX=current standard color The Oscar G. Johnson VA Medical Center located in Iron Mountain, Michigan has a need to acquire 7 exam tables. These 7 exam tables will be placed in the 7 surrounding Community Based Outpatient Clinics. These 7 exam tables will replace older, and outdated tables which do not have the same salient characteristics that are needed to serve the entire Veteran population. These exam tables will allow the highest quality of Veteran care to be given to all Veterans within every Community Based Outpatient Clinic. Currently, there are 7 CBOCs attached the Oscar G. Johnson VA Medical Center located in Iron Mountain, Michigan. The place of performance and delivery is Department of Veterans Affairs, Oscar G. Johnson VA Medical Center, 325 East H Street, Iron Mountain, Michigan 48901-4760. ** To prevent Gray Market Items within the VA, the following is also placed within this sources sought notice: ** (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable.  (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. THIS IS NOT A SOLICITATION AND DOES NOT OBLIGATE THE GOVERNMENT TO ISSUE A SOLICITATION. Please be advised that the Government will not pay for any information submitted under this announcement.
