The 2237 for this procurement is 541-23-2-5796-0644 Nature and/or Description of the Action Being Approved: This activity proposes to solicit with Crazeweld LLC, a SDVOSB business using sole source procurement procedures under NAICS Code 811210 for the repair of four 30,000-gallon fuel tanks located at the Cleveland VA Medical Center. Description of Supplies/Services Required to Meet the Agency s Needs: The estimated value of the proposed action is $745,356.66. The Cleveland VAMC is requesting a contract with Crazweld LLC, to ensure the repair of the fuel tanks will receive the regular preventative maintenance and repairs according to the manufacturers guidelines and specifications. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below: (X) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Due to the strict protocols dealing with fuel and fuel storage there are a limited number of qualified companies that can perform all actions needed. Crazeweld LLC is the only contractor that can perform the full demand, both technically and within the time requirements. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies: Market research was conducted, details of which are in the market research section of this document. Crazeweld LLC is the only contractor that can perform the fuel tank repairs on site and in the same manner the previous fuel tanks have been repaired. This request is being entered as a sole source because these repairs must be repaired by manufacturer standards with the use of OEM parts, tools, and Crazeweld LLC is the only contractor that utilizes OEM parts. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Determination of cost was conducted through the review of similar or like services obligated in FY22 under purchase order numbers 541-C20419. Upon completion, it has been determined that the cost is fair and reasonable. It is determined that this is of the best value and interest of the Government. The selection of this vendor has also been determined as the best value in that the selected vendor has demonstrated the necessary skills and ability to perform the required services at a firm fixed price predetermined to be fair and reasonable. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: VIP queried using NAICS Code 811210 and fuel tank repairs identified Crazeweld LLC as the only SDVOSB contractor identified. Proprietary parts, tools, materials, and software as applicable. - OEM Certified field service engineer. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Third party vendors do not have access to OEM parts. Vendor must exhibit and be authorized the ability to complete all operational modifications according and under manufacturer specifications. Therefore, the VA Rule of Two cannot be met. Any Other Facts Supporting the Use of Other than Full and Open Competition: All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment.
