VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under $250K VHAPM Part 806.3 Other than Full and Open Competition Page 1 of 1 Original Date: 08/30/17 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: (36C250-23-AP-3017) Contracting Activity: Department of Veterans Affairs, VISN10, Cleveland VA Medical Center Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This activity proposes to solicit with Gardiner Trane; a large business using sole source procurement procedures under NAICS Code 811210 for maintenance of the frequency drives that control fan speed and capacity on the air handling and ventilation systems. This will be a multi-year contract (base year with four option years). The Base Year POP is from 6-1-2023 through 5-31-2024 and the total contract price will be $191,054.00. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This request is being entered as a sole source because these items must be installed by the manufacturer standards with the use of OEM parts, tools, and materials ONLY. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Description of market research conducted and results or statement why it was not conducted: FAR 13.106-1-VIP (legacy) search used NAICS 811210, keyword frequency drives , and Ohio (strict) with zero findings. As of January 9, 2023, the agency can no longer use VIP as the principal means seeking CVE verified veteran-owned small business concerns. DSBS search for SDVOSBs and VOSBs applied the same NAICS (811210) and keyword, Ohio , and selected self-certified Service-Disabled Veteran Owned and Veteran Owned (including Service-Disabled Veteran Owned) concerns. The query generated no self-certified veteran-owned small businesses nationwide. A subsequent DSBS search for all other small businesses using any state , and the same NAICS and keywords also generated no results. While VetCert queried using NAICS Code 811210 identified 21 SDVOSB or VOSB contractors however, none are third party contractors associated with Gardiner Trane. Proprietary parts, tools, materials, and software as applicable. - OEM Certified field service engineer. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Third party vendors do not have access to OEM parts. Vendor must exhibit and be authorized the ability to complete all operational modifications according and under manufacturer specifications Therefore, the VA Rule of Two cannot be met.
