VHAPM Part 808.405-6 Limiting Sources Attachment 2: Request for Limited Sources Justification Format >SAT VHAPM Part 808.405-6 Limiting Sources Page 1 of 4 Original Date: 08/30/2017 Revision 03 Eff Date: 03/18/2021 LIMITED SOURCES JUSTIFICATION ORDER >SAT FAR PART 8.405-6 Acquisition Plan Action ID: 36C250-20-AP-4378 (1) Contracting Activity: Department of Veterans Affairs, VISN 10, Dayton VA Medical Center 552-21-1-775-0001 in the amount of $600,000.00 for Dayton VA Medical Center Laboratory Services (2) Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). Order against: FSS Contract Number: 36F79720D0079 Name of Proposed Contractor: ARUP Laboratories, Inc. Street Address: 500 Chipeta Way City, State, Zip: Salt Lake City, UT, 84108 Phone: 801-583-2787 (3) Description of Supplies or Services: The estimated value of the proposed action is $ 600,000.00 The requirement is for esoteric testing, which is testing that is sent to a commercial laboratory when the facility laboratory does not have the equipment, training, or personnel to perform the tests themselves. This is a short-term contract to ensure continuity of services while the VISN wide contract is in the pre-solicitation/pre-award phase. The list of individual tests is attached to the end of this document. (4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. This is a short-term award or bridge contract to provide services while the VISN wide esoteric testing contract is in the pre-solicitation and pre-award phases. The amount of work required for the vendor to connect to the VA system in order to provide electronic test results and the time and effort required to manually enter each test at the beginning of contracts awarded to new vendors (establish new data fields) is time consuming and deemed unnecessary when a VISN wide contract is expected to be solicited in fiscal year 2021. Awarding to a new vendor now and doing all of the necessary work to switch vendors is an unnecessary burden when it is not known who the awardee of the VISN contract will be. FAR 8.405-6(b): Items peculiar to one manufacturer: A patent, copyright or proprietary data limits competition. The proprietary data is: These are direct replacements parts/components for existing equipment. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. (5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Pricing is consistent with their current contract pricing. The customer, technical expert, has also reviewed the individual test pricing and has determined the test prices to be fair and reasonable. (6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research was not conducted for this requirement for the reasons stated above in section 4, however, market research is being conducted in the VISN wide contract. A VISN wide IDIQ contract is is the pre-solicitation/pre-award phases and is expected to be solicited in fiscal year 2021. Competition among all capable vendors is being sought under that requirement. (7) Any Other Facts Supporting the Justification: N/A (8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: A VISN wide contract for esoteric testing is being started to allow for competition.
