Page 2 of 2 QUESTION WITH ANSWER FOR PATENT LEGAL SERVICES 36C24E23R0009 Question: For clarification, does the statement Subcontracting of legal services under this contract is not allowed, other than for foreign filed matters , located in the SOW on page 26 under #5 Personnel Responsibilities and Qualifications, mean that prime/subcontractor arrangements, such as the one mentioned above, are not allowed in RFP responses? Answer: Subcontracting of legal services under this contract is not allowed, other than for foreign filed matters. Per FAR 19.705(2)(b), these services are customarily done in-house because the patent legal process is lengthy, and the quality of performance will be disrupted if the requirement is subcontracted out to different law firms. The services require daily interaction directly with one firm to ensure consistency and quality in the work. Use of subcontracting can interrupt the chain of contractual privity between the Government and the subcontracting attorney, which can interfere with attorney client privileges.
