Attachment 1: Request for SDVOSB/VOSB Sole Source Justification Format >SAT Effective Date: 02/01/2022 Page 1 of 6 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C247-23-AP-5250 Contracting Activity: Department of Veterans Affairs, VISN 07, 534 Ralph H. Johnson Medical Center (2237: 534-23-2715-0019) Nature and/or Description of the Action Being Approved: This a new firm-fixed-price contract to support an annual full-service preventative maintenance on the Excelsius GPS Serial Number GPS-0311. Description of Supplies/Services Required to Meet the Agency s Needs: Excelsius GPS Robotic Navigation Platform combines a rigid robotic arm and full navigation capability into a platform for alignment in spinal surgery procedures. This system allows for use during minimally invasive surgery ("MIS") of the spine which can reduce of incision size, reduce of tissue damage, and decrease recovery time and length of hospitalization. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below: (X) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The manufacturer- Globus Medical, Inc. provides confirmation letter that SDV Medical is their exclusive distributor to offer an Extended Services contract for the system to authorized customers. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies: Only (1) responsible SDVOSB concern has been identified and authorized to perform the preventative maintenance service. Manufacturer of the item, provided a sole source documentation, confirming authorization of the authorized distributor. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Priced quoted was equal to the Independent Government Estimated cost (IGE). Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted and an authorize exclusive letter was provided and stated that only one SDVOSB has exclusive authorization to provide extended service on the Excelsius GPS Robotic Navigation system. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There is no actions planned because SDV Medical is an exclusive SDVOSB for sales and preventative maintenance.
