Attachment 1: Request for SDVOSB/VOSB Sole Source Justification Format >SAT VHAPG Part 819.7008/7009 Sole Source Awards to SDVOSB/VOSB Page 1 of 6 Revision: 01 Effective Date: 01/01/2023 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C245-23-AP-0403 Contracting Activity: Department of Veterans Affairs, VISN 05, 0688 Washington DC VA Medical Center, 50 Irving Street NW, Washington, DC 20422. The Purchase Request Number (2237) is 688-23-1-305-0013. Nature and/or Description of the Action Being Approved: A new firm-fixed-price contract contracting action is being proposed for a CardioDay Holter ECG System with ancillary equipment, training, support, and installation. The nature of this requirement is to replace the replacement the current Holter ECG System. The system integrates with our electronic medical record (i.e. CPRS) and the cardiology information system (i.e. MUSE). The estimated total of the action is $49,083.40. Description of Supplies/Services Required to Meet the Agency s Needs: An upgrade to the current Holter ECG System will provide the clinical team with the ability read and analyze the heart rhythms of veterans more efficiently. CardioDay Holter ECG System is a new technology upgrade to our existing system. The upgrade will provide more speed and advanced features that are more accurate; furthermore, CardioDay Holter ECG System is compatible with the Holter ECG System currently in use in the hospital. The CaridoDay Holter ECG System is currently being used by other VA Medical Centers. This upgrade will give improved collaboration, quality of care, and efficiency in treatment to Veterans. A new firm-fixed-price contract contracting action is being proposed for a CardioDay Holter ECG System with ancillary equipment, training, support, and installation. The GE CardioDay Holter ECG System is the system in use at several VISN 5 VA Medical Centers. It is important that Washington DC obtain a Holter ECG System that is compatible with the other VISN 5 VA Medical Centers to continue the ability to read studies across the VA Medical Centers. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 or 819.7009 up to $5,000,000. Check the specific VAAR clause used below: (X ) 819.7008 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a verified veteran-owned small business. Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Trillamed, L.L.C. is a verified SDVOSB company that meets the requirements of 38 U.S.C. 8127(c), VAAR 819.7008, VAAR 819.7003, and VAAR 819.7009. Trillamed, L.L.C., UEI:GW9FLBWB5625, has a reasonable past performance record. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: TrillaMed, L.L.C is the only authorized distributor under GE Healthcare products to the VA; furthermore, TrillaMed, L.L.C. LLC is an authorized distributor and certified outsource manufacturer of GE Healthcare. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Review of previous contracts, market research, internet search, similar items, FPDs-NG, Sam.gov, and GSA this Contracting Officer finds the pricing is determined to be fair and reasonable and that best value to the government. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted on the internet, FPDs-NG, Sam.gov, SBA and GSA. The vendor met the eligibility criteria outlined in VAAR 819.7003, they are verified in VIP and the action is below the $5M threshold. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. The Contracting Officer is using the authority under 38 USC 8127(c). Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Contracting Officer will monitor market conditions for changes to overcome barriers to competition.
