Attachment 1: Request for Sole Source Justification Format >SAT VHAPG Part 806.3 OFOC Revision: 03 Effective Date: 04/15/24 Acquisition ID#: Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID 36C245-24-AP-3804 Contracting Activity: Department Of Veterans Affairs, RPO East Nco 05, In service toward the Beckley WV VA Medical Center Regarding Ceiling Increase Contract 36C24520D0009 Nature and/or Description of the Action Being Processed: This suplementary modification is to increase the current IDIQ contract 36C24520D0009 ceiling from from $25,000,000.00 to $25,749,000.00 with an increase of $749,000.00. Sole sourced to one responsible provider of current ambulatory services Jancare Ambulance of North Central WV. This ceiling increase will provide time and Provide additional funding toward final month of estimated usage costs as well to award a new contract through the remainder of FY24 through October 31st Description of Supplies/Services Required to Meet the Agency s Needs: The purpose of this requirement is to furnish 24-hour ambulance transportation service for the beneficiaries of the Beckley WV VA Medical Center. This will involve trips to and from any location within the primary service area (psa) of Beckley VA Medical Center. The psa are as followed:The Vamc Beckley, WV, Psa Includes the following counties In West Virginia: Clay, Fayette, Greenbrier, Mcdowell, Mercer, Monroe, Nicholas, Pocahontas, Raleigh, Summers, And Wyoming, And Tazewell, VA. Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This J&A justifies the need for the ceiling increase of IDIQ 36C24520D0009 for ambulatory transport services. It was identified that the original $25 Million dollar ceiling was inadequate for the 5 year action in part due to increased usage from COVID pandemic operations. It is obvious that attempts to solicit for these services and the requirements involved in ambulatory transport, the requirements would result in substantial duplication of cost to the government not expected to be recovered through competition, as well as create unacceptable delays in these crucial services. Accordingly, Jan Care Ambulance Corporation is the only firm capable of providing the services described in Section III above without the Veteran s Health Administration experiencing unacceptable delays in fulfilling its requirements. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Special notice via SAM Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: It is my determination as the Contracting Officer this modification to increase the current contract 36C24520D0009 ceiling from from $25,000,000.00 to $25,749,000.00 with an increase of $749,000.00 is reasonable. To provide for final period of performance coverage for the responsible provider of current ambulatory services Jan Care Ambulance. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research conducted -of Sam verification of Jancare for Modification of current IDIQ Services verification on nonexclusion & eligibility A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Future actions are expected for these ambulatory services encompassing the majority of NCO 05 Facliities end of Period of performance in around 1st of November and currently in solicitation for new base and option year and other requirements still in planning.
