STATEMENT OF WORK (SOW) I. Purpose The Wilmington VA Medical Center (VAMCW or the facility) has a need to properly dispose/recycle of approximately 18,000 gallons of No. 2 oil/heating oil (boiler plant tank) and 9,000 gallons of diesel fuel from underground and above ground storage tanks associated to emergency generators (EGs) and fire pump as identified by the Table 1 of this SOW due to elevated sulfur content in fuel. All units identified by the Table 1 except Bld. 15 s EG tank need to be filled with new fuel with sulfur content equal to or less than 15 ppm. Other job responsibilities are identified by the Action/Remediation section of the Table 1. It is the facility s understanding that the elevated sulfur content in fuel cannot be resolved by fuel polishing alone. The Action/Remediation described by the Table 1 below is necessary to comply with the state and/or federal regulations and the Joint Commissions (JC) standards. The VAMCW is seeking a contractor to facilitate all tasks identified by this SOW. The VAMCW is located at 1601 Kirkwood Hwy, Wilmington, DE 19805. All underground (UST) and above ground (AST) storage tanks are located at the Kirkwood Hwy location within close proximity. To maintain facility readiness and capabilities during emergency situations, the VAMCW is also seeking contractor to have additional Ultra Low Sulfur Diesel (ULSD) fuel available for use at the site during Action/Remediation process described by the Table 1 of this SOW. II. Period of Performance The prosed project does not have any option year contracts. III. Services & Requirements and Initial Fuel Delivery The contractor shall submit safety and spill prevention plans to project COR (contract officer representative) and VAMCW Safety Manager for carrying out the requirements of this document. The spill prevention and safety plans including confined space entry must be approved by the VAMCW before project can start. All tanks identified by the Table 1 will be filled up with new ULSD to a maximum 90% capacity or as recommended by the manufacturer s specification. Contractor will be required to remove all over-fill fuel if the monitoring system detects the tank is filled over 90% forcing it to alarm. Contractor is responsible for the removal and cleanup of all fuel that is spilled during the fuel disposal or refueling process. This will include any fuel spilled in all underground storage tank sump containments. Facility staff will continually monitor the contractor during the fulfillment of all services rendered under this contract to ensure compliance with this requirement. All spill response efforts must be in compliance with DNREC, Delaware Emergency Response Program or any other applicable local regulations. All discarded fuel will be transported out of the facility, recycled, or disposed of by the contractor with no additional cost to VAMCW. All fuel credits for waste fuel will be applied to services rendered as part of this contract or issued directly to the facility. All delivered fuel oil or diesel fuel will have a sulfur content equal to or below 15 ppm (0.0015% by weight) which will be confirmed by the contractor by providing copies of the fuel manifest from each fuel delivery to the site during the Action/Remediation process identified by the Table 1 of this document. In addition, within 60 calendar days of the project completion, the contractor shall provide third-party testing on the fuel in the tanks listed in this document that complies with ASTM D, NFPA 110 and the Joint Commission requirements for mission critical equipment. Appropriate remediation is required by the contractor if the required sulfur content is not achieved. The facility s goal from this project is to achieve compliance with the JC standards for fuel quality including sulfur content in fuel and to comply with the State/EPA requirements for ULSD that can be burned on the fuel burning equipment. The contractor shall discuss with the contracting officer and the facility COR prior to the actual work if the proposed actions by this SOW may not help to achieve facility s goal. The contractor s technician(s) assigned to provide the services required under this document must have all applicable valid training certificates. IV. Scheduling of Services All work completed under this contract will be required to be scheduled in close coordination with the COR and the contractor. Contractor will be responsible for emptying tanks as scheduled and approved by the COR. Scheduling may be staggered to accommodate scheduling requirements of the facility and maintain sufficient fuel onsite to maintain facility readiness for emergency purposes and allow all fuel tanks to be cleaned before fuel replenishment. The COR and other facility staff will attempt to give contractor as much lead time as possible when scheduling the removal of all waste fuel and refueling of facility fuel tanks after they have been cleaned however this may not always be possible. All or part of Action/Remediation processes outlined by the Table 1 may need weekend works to minimize traffic and safety issues. The weekend work schedule must be consulted with the COR in advance. 6. It is of great importance that the facility maintain compliance with VHA requirements of maintaining facility readiness for emergency situations including maintaining adequate backup fuel sources on premises. As a result, the contractor will be responsible for having fuel in sufficient quantities to fill all underground storage tanks and generator tanks immediately after tank cleaning is completed.
