This notice serves as a Sources Sought in support of market research and/or planning purposes only and does not constitute a solicitation. This notice is not a confirmation that the Government will contract for the items or services contained in the sources sought, nor is any commitment on the part of the Government to award a contract implied. This notice does NOT constitute an Invitation to Bid, a Request for Proposal, or a Request for Quote. The Government shall not pay and/or reimburse respondents and/or associates for any costs incurred to submit the requested information. All information received in response to this sources sought that is marked Proprietary will be handled accordingly. In accordance with FAR 15.201(c), response to this sources sought is not offers and cannot be accepted by the Government to form a binding contract. Please provide a technical capability statement addressing how your firm would meet the requirement in the SOW. Please provide estimated monthly pricing in accordance with the statement of work. STATEMENT OF WORK FOR PHARMACEUTICAL WASTE MANAGEMENT WILKES-BARRE VETERANS AFFAIRS MEDICAL CENTER 1.0 PURPOSE: To comply with Environmental Protection Agency 40 CFR, and Department of Transportation (DOT) regulating the generation, transport, and disposal of hazardous waste. 2.0 SCOPE: The contractor shall provide all labor and materials to collect, transport, and dispose of pharmaceutical waste at the Wilkes-Barre Veterans Affairs Medical Center. PERFORMANCE REQUIREMENTS: The contractor shall provide disposable and reusable pharmaceutical waste containers in the following types: 8 gal Blue for non-hazardous pharmaceutical, 8 gal Black for hazardous, 8 gal purple for flammable and toxic 2 gal Black Sharps container for sharps with medication, 5 gal white for p-listed. Currently the Medical Center uses Stericycle pharmaceutical waste containers. The contractor shall include step on dollies and mounting brackets as applicable. The contractor shall provide plastic liners for 8 gal containers and zip lock bags for each step on dolly. The contractor shall provide two pickups (transportation off site for disposal) per month of non- hazardous pharmaceutical waste and monthly pickup of hazardous pharmaceutical waste at the Medical Center to include manifesting. All pickups shall include weights for each type of waste. Pickups do not include expired pharmaceutical waste designated to be returned for credit, or controlled substances. The contractor shall provide pharmaceutical formulary waste characterization. The contractor shall provide pickup of thirty eight (38) satellite accumulation areas within the Medical Center. The contractor shall check satellite accumulation areas weekly, replace full containers as necessary and transport full to the central accumulation area. The contractor shall properly segregate and dispose of hazardous and non-hazardous pharmaceutical waste. The contractor shall coordinate proper placement of containers with Pharmacy. The contractor shall not work on Federal Holidays or weekends. Contractor staff shall wear company badges with company name and employee name. 4.0 PERIOD OF PERFORMANCE: The period of performance is one, 12-month, base period. RECORDS MANAGEMENT LANGUAGE FOR CONTRACTS The following standard items relate to records generated in executing the contract and should be included in a typical Electronic Information Systems (EIS) procurement contract: Citations to pertinent laws, codes and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract. The Government Agency owns the rights to all data/records produced as part of this contract. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.]. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information. END OF STATEMENT OF WORK
