This announcement constitutes the -only solicitation; quotes are being requested, and a written solicitation document will not be issued. This solicitation is issued as an RFQ. The associated North American Industrial Classification System (NAICS) code for this procurement is (324110), with a small business size standard of 1500 employees. The FSC/PSC is 9130 The Bath VA Medical Center requests Off-Road Red Dyed Diesel, Ultra Low Sulfur with 15 ppm) for seamless operation of its facilities and equipment. All interested companies shall provide quotations for the following: Supplies/Services THIS IS A BRAND NAME or EQUAL IDIQ ONLY REQUIREMENT FOR: Red Dyed- low sulfur Off-Road Diesel. (15 ppm). Product Specifications (for supplies) Purchase Requirement of Off-Road Diesel (Red Dyed) for the Bath VA Medical Center Fuel Tank Systems. To ensure the seamless operation of its facilities and equipment, Bath VAMC requires a consistent supply of off-road diesel (red dyed) for its fuel tank systems. The tank system has a capacity of 2,000 gallons. This specific fuel types is chosen based on the compatibility with the facilities equipment and Generators, as well as their environmental considerations and regulatory compliance. It is requested that this requirement be an Indefinite Delivery, Indefinite Quantity (IDIQ) contract to ensure consistency, reliability, and compliance with regulatory and operational standards throughout the duration of the contract. The objective of this requirement is to procure and deliver off-road diesel (red dyed) to Building 14 s Diesel Fuel Tank System at the Bath VA Medical Center to meet the facility fuel requirements. The contractor is required to follow all applicable federal, state, and local laws related to environmental health/safety standards, to include VA and agency policies concerning security. Estimate Delivery Quantities The information below is based on what is known by the Government of the quantity of gallons of Off-Road Diesel (Red Dyed) delivered to the Bath VAMC within a 12-month period. The gallons listed are not per delivery but are the total estimated amount over the course of the entire year. The Government makes no claim as to the accuracy of this information nor is this estimate a representation to an offeror or contractor that the estimated quantity will be used or that conditions affecting requirements will be stable or normal. Off-Road Diesel (Red Dyed): 4000 Gallons Deliverables and Delivery Schedule The Contractor s services will be required on an on-call basis, as needed, and will occur during the normal business hours. Notifications will be provided in writing or via telephone when facility tanks reach one-quarter capacity. Facility tank is monitored by VA Facility Staff. Normal business hours are from 8:00 am 4:30 pm Eastern Standard Time, Monday through Friday. The fuel must be delivered in appropriate containers or storage tanks designed for transportation and storage of petroleum. Handling procedures must adhere to industry best practices to prevent spillage, contamination, or other forms of product degradation during transit and delivery. The manuals, handbooks or brochures shall be provided in hard copy, soft copy or with electronic access instructions, consistent with standard industry practices for the equipment or device. Where applicable, the manuals, handbooks or brochures will include electrical data and connection diagrams for all utilities. The documentation shall also contain a complete list of all replaceable parts showing part number, name, and quantity required. (End of clause) 852.212-71 Gray Market and Counterfeit Items. As prescribed in 812.301(f), insert the following clause in solicitations and contracts for new medical and information technology equipment: GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023) (a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory. (b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics. (c) Vendor shall be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
