(d) This Sources Sought is issued by VISN 2 Contracting Office in New York, NY for the purpose of collecting information on Regulated Non-Medical Waste Disposal & Recycling services for the New York Harbor Healthcare System 3 sites (New York Campus 423 East 23rd Street, New York, NY 10010; Brooklyn Campus 800 Poly Place, Brooklyn, NY 11209; and St. Albans Community Living Center 179-00 Linden Blvd, Jamaica, NY 11425). The VA is seeking to provide for this requirement as of October 01, 2021. The NAICS code identified for this requirement is 562112 Hazardous Waste Collection. The requirement is detailed in the Statement of Work section of this document. (e) Cursory market research has identified several small businesses that may be able to provide for this requirement. Contractors that are able to meet the requirements in the attachment are encouraged to email a capability statement and full information to Monique Paltan at Monique.Paltan@va.gov by Monday, June 28, 2021 at 3 PM EST. - Part of the purpose of this sources sought is to determine the viability of set aside to a specific socio-economic category. Contractors shall identify the NAICS code for the services being offered as well as their size status under said NAICS. If contractor is a Service-Disabled Veteran Owned Small Business (SDVOSB), a Veteran Owned Small Business (VOSB), or any other special category of contractors, then contractor is responsible for providing documentation in support of this. This information will be used to determine the viability of a set aside for this requirement. If any of the requested information is not supplied with the package, this may result in the contractor not being considered in the Government s Procurement Strategy. - Contractors shall also identify any Federal Supply Schedules that may carry the desired services. - Contractors shall identify pertinent point of contact for company, contractor DUNS number for size standard and socioeconomic verification in SAM and VIP, as well as for any intended subcontractors. - Contractor shall provide 2 to 3 instances of past experience which demonstrate that they are a firm regularly engaged in this type of work, to include subcontractors for those jobs. - Contractor shall provide a listing of any teaming agreements they intend to employ in the performance of this requirement if awarded. - Contractor shall supply proof of any applicable certification or training required to meet the regulatory requirements, if applicable. - Contractors shall include any relevant comments about the Attachment(s) if applicable. STATEMENT OF WORK REGULATED NON-MEDICAL WASTE DISPOSAL 1. BACKGROUND: Department of Veterans Affairs, New York Harbor Health Care System (NYHHS) is seeking a qualified contractor with the capability and capacity to provide annual hazardous waste, non-hazardous waste and universal waste pickup, transportation and disposal services at its three (3) campuses (Brooklyn VA Medical Center, Manhattan VA Medical Center and St. Albans Community Living Center (CLC)) in accordance with current federal, state and local regulations. SCOPE: Contractor shall provide all personnel, equipment, tools, vehicles, materials, supervision, and other items and services necessary to perform pickup and disposal of various regulated non-medical waste streams generated by the VA New York Harbor Healthcare System (NYHHS). Contractor shall provide all services as specified in this document and as listed in Attachment 1- Quantities Table. Services shall include all labor, incidentals. packing materials, tools, equipment, analysis, travel, transportation, documentation, waste treatment, disposal and support services required to categorize, package, transport, document and dispose of hazardous, non-hazardous, and universal wastes and certain recyclable materials from NYHHS facilities. Contractor and the Contracting Officer s Representative (COR) will arrange for a routine (non- emergency) service at the facility, in accordance with the schedule outlined herein. The successful offeror must possess the necessary technical expertise and resources required by this solicitation in order to be considered for contract award. Contractor shall provide all necessary labor (trained employees), vehicle, equipment, supplies and incidentals to conduct the activities described below. Work shall be performed in accordance with all applicable, Federal, State, Local and all governing regulations. All hazardous and non-hazardous materials will be disposed of by the Contractor in accordance with current Federal, State and local guidelines governing regulated hazardous and non-hazardous chemical wastes. 2. DELIVERIES/PICKUPS: Shall be conducted in accordance with the schedule below. Specific pickup dates shall be coordinated in advance between contractor and COR. All waste pickups shall be conducted between the hours of 8AM to 3PM, Monday through Friday, excluding Federal holidays. Note: The anticipated quantities of various types of regulated waste requiring disposal are included in Attachment 1- Quantities Table. SPECIFICATIONS: Contractor shall prepare a written profile and characterization of each waste stream per New York State Department of Environmental Conservation (NYSDEC) and US Environmental Protection Agency (EPA) regulations to determine whether the waste is considered a Resource Conservation and Recovery Act (RCRA) hazardous waste and provide a profile for each waste stream. The characterization of the waste stream shall be based on generator knowledge, supplemented by analytical sampling as required. The Contractor shall obtain permission from the COR prior to conducting chemical analysis to be charged against the contract. Segregate the chemicals by compatibility and waste stream. The waste is stored in various locations throughout the facilities. Provide trained personnel and material to package small containers into a larger container with appropriate packing material (also known as lab packing). Prior to transporting the waste, contractor will package it in accordance with the applicable U.S. Department of Transportation regulations set forth in 49 CFR Parts 173, 178, and 179 (and must label and mark each package in accordance with the applicable U.S. Department of Transportation regulations (49 CFR 172) and NYSDEC/USEPA RCRA regulations. Prior to transporting the waste, contractor must provide and placard with the appropriate placards the transport vehicle according to U.S. Department of Transportation regulations for hazardous materials (49 CFR part 172, subpart F). Complete all the necessary paperwork (advance notification per NYSDEC regulation to generator from Treatment, Storage and Disposal Facilities (TSDF) and transporter, provide returned copy of manifest from TSDF, returned copy of shipping document from recyclers, packing slips, waste characterization documentation, waste profiles, manifests, container labels, transport vehicle placarding, and Land Disposal Restriction Certification Forms (LDR s). All manifests, waste determinations, waste generation data, shipping information and other data required for the proper execution of this contract will be maintained by the contractor in an electronic database format that is exportable through a Microsoft Excel or Microsoft Access format. All required paperwork including fully signed return copies of manifest shall be provided within 21 days of waste leaving the site. Exceptions to this must be approved by the COR. 4. CONTRACTORS RESPONSIBILITES: Contractor shall ensure: Per 6NYCRR372.2(b)(2)(i), prior to shipping the waste, contractor will provide the waste generating facility with a written communication from the designated treatment, storage or disposal facility and alternate treatment, storage or disposal facility that it is authorized to handle the particular hazardous waste described on the manifest. Per 6NTCRR372.2(b)(2)(iii), prior to shipping the waste, contractor will provide written confirmation from the designated transporter(s) to the COR that they are authorized to deliver the manifested waste to the designated treatment, storage or disposal facility. Contractor will provide a certificate of recycling for each recycled waste within 30 days of shipment. Review existing waste profiles to ensure consistency of the waste profiles completed by the vendor with existing waste profiles maintained by the waste generating facility. Provide Department of Transportation (DOT) approved containers appropriate for the type of waste shipped. Load and ship the waste in a DOT and NYSDEC-permitted Contractor vehicle. Contractor will provide the waste service and shipping date to the requesting service. The date must be acceptable to the requesting service. The Contractor will provide the services between 8:00 AM and 3:00 PM on weekdays only. Contractor will provide the per unit cost/price and total cost (price) for each waste stream, and any other costs, using the form provided in this scope. Price will be based on per unit quantity, not a flat rate. No direct landfilling of waste is allowed under this contract. The waste must be recycled, incinerated or otherwise treated. No waste shall be exported to any facilities outside the United States. Contractor will immediately (within two hours) notify the waste generator in case of an off-site spill or any incident involving the shipped waste. Should any waste be released during the performance of services under this contract, through no fault of the VA facilities, the Contractor will be responsible for all costs associated with the satisfactory remediation of the incident. This will include the cost of all labor and materials as well as any actual damages incurred to the facility and harm caused to patients, visitors and staff of the medical center. The remediation efforts shall be performed to the satisfaction of regulatory authorities and NYHHS. Contractor will be responsible for properly containerizing all lab-packs and for assuming all safety measures (example: Personal Protective Equipment (PPE)) to prevent harm or injury to VA patients, visitors, employees, Contractor employees and the environment. The VA COR, Green Environmental Management System (GEMS) Program Manager, facility safety personnel and VA Police have the authority under this contract to present a verbal stop work order pertaining to job activity they reasonably believe represents an imminent hazard to life, property or the environment. This verbal order shall be followed up by a written stop work order issued by the Contracting Officer as soon as feasible after the imminently hazardous situation has been stabilized or abated. 5. LICENSES AND PERMITS: Contractor will, without additional cost to the Government, provide and maintain all licenses and permits for operational personnel, containers, vehicles, trailers and other resources required for proper removal of hazardous and non-hazardous chemical waste in accordance with all applicable Federal, State, Municipal, and local regulations (e.g. Occupational Safety and Health Administration (OSHA), Drug Enforcement Administration (DEA), Environmental Protection Agency (EPA), Department of Environmental Protection (DEP) NYC, Department of Transportation (DOT)). If appropriate licenses are not maintained in accordance with Federal and State requirements, the VA may terminate the contract effective upon discovery. The VA reserves the right to halt work if the Contracting Officer and or COR determine work is being done in an unsafe/unhealthy manner or that could harm the environment. VA will not incur additional costs if work is halted for good cause. The following shall be provided to the Contracting Officer with bid proposal submission for evaluation purposes and annually with any changes to original submission clearly identified and highlighted: 5.1 Current waste transporter permit (s): Contractor shall: List of all transfer stations, treatment, storage and disposal facilities (TSDFs) including incineration, wastewater and sludge treatment facilities that shall be utilized during this contract to include the capacity of these facilities and the waste codes for the waste streams they are permitted to accept by treatment technology. Address, phone number, EPA identification number and other contact information shall be provided. The VA reserves the right to inspect each of these facilities before approving its use or at any time during or after contract period while VA wastes are present. 5.2 Copy of Operator permit(s): Contractor shall provide: Certificates of training and experience of staff and/or personnel who will perform site work under this contract (all technicians that will work on VA premises will be expected to have received at least the minimum training required by law as specified in 29 CFR 1910.120, 40 CFR Parts 260-265 and 49 CFR Parts 171-178). Before allowing employees to start work under the terms of this contract, the Contractor shall ensure that employees have the required qualifications and, if applicable, have the required current and valid professional certifications and licenses in compliance with federal, state, and local environmental requirements or laws. Personnel operating motor vehicles will have a valid state driver s license and abide by all NY Harbor Healthcare System traffic laws, i.e. hands-free cell phone use while driving, and parking requirements. When requested, the Contractor will provide the CO and on-site COR with information on the qualifications or certifications for employees and sub-Contractors. 6. DENTAL AMALGAM SEPARTORS MAINTENANCE: Contractor shall be responsible for the filter changeout and maintenance of the Solmetex Corporation silver-mercury dental amalgam separator systems described in Attachment 1, including the periodic change-out and proper recycling of the amalgam collection containers. The Contractor shall provide all new filters, parts, materials, labor and proper recycling of the waste including written documentation/certificates of recycling. The Contractor shall follow all manufacturer s recommended instructions for servicing the units. Fill out the information label: Enter the Date Installed on the new collection container. Enter the Next Change Due on the new collection container. Note the vacuum gauge reading. The reading should be the same as before the collection container change. Ship back the old collection to Solmetex (the manufacturer) for recycling. Obtain the recycling certificate and provide a copy to the COR. 6.2 Vacuum Line Cleaning: Contractor shall: Follow manufacturer s guideline for cleaning the vacuum lines and use vacuum line cleaners that have a pH between 6 and 10 or as recommended by manufacturer. Remove all deposited amalgam sludge to ensure that the vacuum continues to operate effectively. 7. PERIOD OF PERFORMANCE: Services performance will be from 10/01/2021 to 09/30/2022 with the provisions for four (4) Option Years. 8. PLACE OF PERFORMANCE: Service performance will be for the NY Harbor Healthcare System three (3) campuses.
