This is not a solicitation. The Department of Veterans Affairs intends to negotiate a sole source contract with Battelle Memorial Institute, located at 505 King Avenue, Columbus, OH 4320, to obtain FDA approved decontamination services on N95 and N95-equivalent respirators for the VA Healthcare facilities in VISN 1, New England. The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1. A Justification and Approval was completed to describe this Sole Source requirement and how the required criteria are met. The J&A will be posted to FBO after award as required. Battelle is the only known FDA approved outlet to provide decontamination for N95 and N95-equivalent respirators for the novel coronavirus (SARS-CoV-2). Since the intent is to procure these services on a sole source basis, no solicitation will be posted on FBO for Contract Opportunities. The Department of Veterans Affairs intends to solicit directly with Battelle Memorial Institute for a Firm Fixed Priced contract for one-year period of performance to commence on or about 04/10/20209. Services shall be provided in accordance with the Performance Work Statement (PWS). The applicable NAICS code is 621511 with a 35 Million Size Standard. The FSC/PSC is Q201.
