This is a brand-name justification for contracting by other than full and open competition prepared by the OCC AQM for information technology (IT) support services from International Business Machines (IBM) Corporation for Treasury’s ITS Division. The anticipated action will result in a firm-fixed-price delivery order to maintain 650 OCC IBM licenses. The ordering office intends to enter into contract, under a sole-source authority, by issuance of a single award contract for IBM software tool offered under the North American Industry Classification System (NAICS) Code 541519—Other Computer Related Services, with a size standard of $30M. The Contractor for which the Government sought to enter into a contract agreement is International Business Machines Corporation (IBM Corp), which is an other than large business. This is a brand-name acquisition for IBM Extended Support which will be for services estimated to end after 1 year. The resulting contract will not include or require any option periods. The period of performance will begin November 1, 2022 with an ending date of October 31, 2023. This justification supports the Government need for continuity of daily operations using IBM Corp products and services necessary to ensure that the current OCC IBM licenses remain current, operational, and updated in supporting OCC’s network systems. This brand name acquisition is in accordance with 41 U.S. Code § 3304 (a)(1) as implemented by FAR 13.106-1(b)(1)(i) of which market research determined that IBM Corp is the only source reasonably available of providing the IBM’s Rational Collaborative Lifecycle Management V6.0.1 (5725-F21) tool. IBM Corp is the developer, owner, and patented provider of the products and services specifically required for this acquisition, for which there are no authorized resellers. Therefore, this product must be purchased directly from the manufacturer. The Government currently uses the IBM Corp’s Rational Collaborative Lifecycle Management across the entire agency.
