IRS Management and the National Treasury Employees Union (NTEU) are unable to come to an agreement on a negotiation issue and Arbitration is invoked, an Arbitrator is selected to hear the case and provide a report of findings regarding the issue. Pursuant to the federal labor statutes, the parties have collectively bargained that arbitrations will be heard by a standing panel of arbitrators and that case assignments are rotated amongst those arbitrators only. Therefore, we must use this arbitrator for this case to comply with the statutorily authorized collective bargaining agreement. The parties agreed upon the rates reflected in this request as part of this agreement to serve on the panel, and the rates are well within market rates charged by similarly contracted arbitrators for these panels.
