AMMENDMENT 1: Incorporate FAR 52.204-27 Prohibition on a ByteDance Covered Application (JUNE 2023) (i) This is a combined synopsis/solicitation is for the purchase and delivery of 990 tons of 3/4-inch maximum class 2 aggregate base gravel along the highway at Lake Berryessa. Please see the attached description under FAR Part 12.6 and the attached RFQ package. (ii) Solicitation number 140R2023Q0088 is issued as a request for quote (RFQ). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-03. (iv) This acquisition is a total Small Business set aside. The NAICS code is 212321 and the size standard is 500 employees. (v) The contract line items are listed in the price schedule of the solicitation package. When providing a quote, please complete the price schedule for each line item. (vi) The contractor shall provide ¾ inch Class 2 Aggregate rock at Lake Berryessa in accordance with the Statement of Work that is included in the solicitation package. (vii) The delivery of the aggregate rocks needs to be made by July 11, 2032. (viii) The provision 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services, applies to this acquisition. The quote package will consist of the price schedule. (ix) The provision 52.212-2, Evaluation-Commercial Products and Commercial Services, does apply to this acquisition. Award will be based on price and able to meet delivery date. (x) The provision 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, applies to this acquisition. (xi) The clause 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services, applies to this acquisition. There are not any addenda to this clause. (xii) The clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Products and Commercial Services, applies to this acquisition. The applicable clauses cited within this clause are indicated in the solicitation package. (xiii) All additional contract clauses and provisions are included in the attached solicitation package. (xiv) The Defense Priorities and Allocations System (DPAS) do not apply to this acquisition.
