ONE UTV FOR HORTON AGENCY, HORTON, KS This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This procurement is being set aside 100% for Indian Small Economic Enterprises (ISEE) in accordance with the Buy Indian Act Regulations. The Solicitation No. is 140A0323Q0004 and is a request for quotes. The Bureau of Indian Affairs has a need for a UTV. Equipment needs to meet or exceed what is specified in the attachments. Equipment will be used for land management projects and needs to met what is specified. Equipment also needs to have a dealership within 60 miles of Horton, KS for easy servicing. The North American Industrial Classification System (NAICS) code is 336999, with a small business size standard of 1000 employees. Contractor is required to be registered in SAM with the NAICS Code cited above prior to bid opening. Delivery - Vendor must notify the point of contact to confirm delivery date and time, Monday through Friday between the hours of 8:00 am and 4:30 pm and closed on Federal Holidays and weekends. Specifications The Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-01, December 30, 2022. In paragraph (b) of FAR 52.212-5(b), the Contractor shall comply with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: FAR 52.223-18, Encouraging Contractor Policies to Ban Text Messaging while Driving; FAR 52.225-1 Buy American Act-Supplies; FAR 52.232-33, Payment by Electronic Funds, 52.232-99, Providing Accelerated Payment to Small Business Subcontractors. 52.212-2 Evaluation - Commercial Products and Commercial Services.(NOV 2021) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made using a Lowest Price Technically Acceptable (LTPA) approach; the Government will award to the lowest priced offeror that is determined to meet or exceed the specifications. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer¿s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
