PROJECT TITLE: GUARDRAIL REPAIR PROJECT - FORT THOMPSON, SD DESCRIPTION: Project consists of the repair of 300 linear feet of retention 3 cable guardrail. All work to be completed in accordance with the statement of work, contract terms and conditions. PROJECT LOCATION: The construction site is on the Crow Creek Indian Reservation, BIA Route #4, approximately 5.67 miles east, from the four way intersection in Fort Thompson, Buffalo County, South Dakota. Those bids without the certification will be deemed unresponsive. 6. ISBEE Certification Form MAGNITUDE OF PROJECT: As required under FAR Part 36.204, Project Magnitude is under $10,000. Due to magnitude, a Pre-Solicitation is not required. TERO: The Tribe does have a TERO Ordinance that will apply. The current TERO Tax is 8% and is due prior to the start of work. A copy of the Ordinance is attached. Awarded contractor will also be required to submit a COVID Preventive Plan. A copy of the letter from the Tribe is also attached. SUBMITTAL OF BIDS: Bids are to be submitted by email to the Contracting Officer, Jocelyn LittleChief. Project name and solicitation number should be cited in the subject line of the email. Email address is: Jocelyn.littlechief@bia.gov. NAICS CODE: The North American Industry Classification Code (NAICS) is 237310- Highway, Street and Bridge Construction, with a size standard of $39.5m. SOCIOECONOMIC PROGRAMS: This procurement is being set-aside exclusively for Indian Small Business Economic Enterprises (ISBEE)as defined under the Buy Indian Regulations 48 CFR PART 1480. Only those vendors that are registered in SAM as an ISBEE under the stated NAICS Code can submit a bid. Due to issues with SAM, all bidders will need to be registered and active at the time bids are due. Those not registered will be eliminated and determined as non-responsive. DAVIS BACON ACT: Contractor is required to comply with the Davis Bacon Act. BONDING: The Government is expecting bids to be under $10k, therefore bonding is not required.
