Notice of Intent to Award a Sole Source Contract PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED. The Federal Bureau of Investigation (FBI) intends to execute a firm-fixed-price (FFP) contract period of performance extension action with KiteWire Inc. whose address is 1100 N GLEBE RD STE 1010, ARLINGTON, VA 22201-5786, to obtain FBI Historical Data on PO 15F06718P0008110. It is the intent of the Government to extend the current contract, 15F06718P0008110, with KiteWire Inc. to obtain FBI Historical Data. The extension will be a period of performance of 12-months at a total price of $811,444.88. The Government shall utilize authority 52.212-4(c) in order to continue receive FBI Historical Data. The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Only this suggested source can furnish the requirement due to other vendors not having access to the proprietary data stored within the KiteWire, Inc.’s platform to transfer it to the FBI. KiteWire, Inc. is uniquely qualified to provide these services due to its ability to monitor and manage mobile device activity, perform incident response, and respond to DOJ-required eDiscovery requests since September 2013. As such, KiteWire, Inc. possesses pertinent FBI proprietary data until such data can be transferred to an FBI-managed instance. Due to the amount of time it takes to extract the data, the transfer cannot be completed within the current POP and requires an extension to allow for more time for the vendor to complete the data extraction. An extension to the Period of Performance is necessary to ensure the FBI can access all applicable data on KiteWire, Inc.'s cloud platform. Failure to extend the period of performance will render the remaining FBI historical data from 2019-2023 inaccessible, subsequently hindering the availability of vital information used by the Office of the General Counsel (OGC) and User Activity Monitoring (UAM) for legal and insider threat purposes. This notice will be distributed solely through the SAM.gov website. Interested parties are responsible for monitoring the SAM.gov website to ensure they have the most up-to-date information about the acquisition. This notice of intent is not a request for competitive quotes; however, the Government will consider any responses from capable sources received no later than 8:00am EST, September 13, 2023.
