The U.S. Department of Justice, Drug Enforcement Administration intends to award a sole source purchase order to Advanced Programs, Inc. (API) for Foreign Tempest Merlin Equipment software to support hybrid cloud initiatives of DEA and DOJ. This specific hardware and software is proprietary to Foreign Tempest Merlin Equipment software and cannot be supported by another vendor. The proposed purchase order is for Foreign Tempest Merlin Equipment software for which the Government intends to solicit and negotiate only with Advanced Programs, Inc. (API). Inc. In accordance with Competition in Contracting Act 41 USC 253(c)(1), as implemented by FAR 6.302-1, other than full and open competition is authorized when there is only one responsible source and no other supplies and services will satisfy agency requirements. Justification for the determination is attached. The following FAR Part 12.r provisions and clauses are applicable to this acquisition: 52.12-4 (Feb 2007) Contract Terms and Conditions - Commercial Items and 52.212-5 (Apr 2008) Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial Items. A determination by the Government not to open the requirement to competition based on the response to this notice is solely within the discretion of the Government. This notice of intent is not a request for competitive quotation. A Request for Quotation (RFQ) is not available.
