The U.S. Department of Justice, Drug Enforcement Administration intends to award a sole source purchase order to CDW Government. Inc. for Amazon GovCloud Web Services subscription to support hybrid cloud initiatives of DEA and DOJ. This specific hardware and software is proprietary to Amazon GovCloud Web Services and cannot be supported by another vendor. The exception to fair opportunity when brand name descriptions are used is based on FAR 16.505(b}(2}(i}(B)- "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." The proposed purchase order is for Amazon GovCloud Web Services for which the Government intends to solicit and negotiate only with CDW Government. Inc. In accordance with Competition in Contracting Act 41 USC 253(c)(1), as implemented by FAR 6.302-1, other than full and open competition is authorized when there is only one responsible source and no other supplies and services will satisfy agency requirements. Justification for the determination is attached. The following FAR Part 12.r provisions and clauses are applicable to this acquisition: 52.12-4 (Feb 2007) Contract Terms and Conditions - Commercial Items and 52.212-5 (Apr 2008) Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial Items. A determination by the Government not to open the requirement to competition based on the response to this notice is solely within the discretion of the Government.
