The U.S. Department of Justice, Drug Enforcement Administration intends to award a sole source purchase order to ForcePoint Professional Services for TGS Upgrade from 4.x to 5.x. This specific hardware and software is proprietary to Forcepoint and cannot be supported by another vendor. All communication regarding this posting shall be in writing and be received by the archive date of this notice. Point of contact is Calvin Jackson, email calvin.jackson@usdoj.gov. The proposed purchase order is for TGS Upgrade from 4.x to 5.x for which the Government intends to solicit and negotiate only with ForcePoint Professional Services. In accordance with Competition in Contracting Act 41 USC 253(c)(1), as implemented by FAR 6.302-1, other than full and open competition is authorized when there is only one responsible source and no other supplies and services will satisfy agency requirements. Justification for the determination is attached. The following FAR Part 12.r provisions and clauses are applicable to this acquisition: 52.12-4 (Feb 2007) Contract Terms and Conditions-Commercial Items and 52.212-5 (Apr 2008) Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial Items. The full text provisions and clauses may be accessed electronically at this internet address – www.acqusiition.gov/fas. The Government anticipates the award of a firm fixed price purchase order. A determination by the Government not to open the requirement to competition based on the response to this notice is solely within the discretion of the Government. This notice of intent is not a request for competitive quotation. A Request for Quotation (RFQ) is not available.
