REQUIRING AGENCY - DOJ/Bureau of Prisons, United States Penitentiary Atwater 2. NATURE/DESCRIPTION OF ACTION BEING APPROVED - Sole source acquisition 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS Agency requires modular plate carriers (tactical vest) to hold ballistic armor plates currently on inventory. Estimated value of requirement is $51,108.00. 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION - 41 U.S.C. 253; 41 U.S.C. 1901(e) 5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED: Current inventory of hard and soft armor plates was purchased by Victory Tactical Gear, and the warranty on all inventory will be voided if these armor plates are inserted into a tactical carrier/vest other than Victory Tactical Gear's carrier/vest. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE: The plates are under a 5 year warranty, which would be voided if a tactical carrier/vest from a different manufacturer is used. Therefore, the tactical carriers/vests are proprietary for 5 years. Once the 5 year warranty period has expired, any additional requirement of this nature would be solicited through the appropriate sources.
