The Department of Homeland Security, U.S. Immigration and Customs Enforcement, Office of Acquisition Management, intends to award a sole source contract modification on a basis of other than full and open competition in accordance with the requirements of FAR 6.303-1. This modification increases the ceiling by adding supplemental in-scope requirements to the Krome Service Processing Center detention services contract, HSCEDM-14-D-00002. This modification will be issued under the authority of FAR Subsection 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements.” In July 2019, ICE authorized the use of Oleoresin Capsicum Aerosol Spray (OC Spray) at the Krome facility and directed the regulated use of the OC Spray by trained ICE and security staff, inclusive of the detention facility’s prime contractor, Akima Global Services. This modification provides the supplies, training, and certification of the applicable contractor detention staff to ensure compliance with the newly issued ICE field policy. This announcement serves as notice of intent to award a sole source modification under the current contract and is not a Request for Proposals and no solicitation is forthcoming. However, responsible sources that believe they can perform these services in their entirety may submit a written notification of interest and a capability statement by 12:00pm Eastern Daylight Time (EDT), Friday February 28, 2020 which will be considered by the agency. ICE will not be responsible for any costs incurred in response to this notice. Capability statements shall be submitted to the Contract Specialist at Edward.Kirksey@ice.dhs.gov. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. This notice in no way obligates the Government to award any modification to the existing contract.
