The US Customs and Border Protection (CBP) intends to award a sole source contract to Lockheed Martin Aeronautics for the engineering services necessary to maintain the P-3 aircraft and its associated mission system software, access to Original Equipment Manufacturer (OEM) drawings for the P-3 Aircraft, as well as an Operational Usage Analysis study. The statutory authority permitting other than full and open competition is U.S.C.3304(a)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. Lockheed Martin Aeronautics is the original aircraft manufacturer of the P-3 aircraft and mission management system (MMS) software. Lockheed Martin Aeronautics owns and controls all data rights to the mission system and airframe related data. The Government will award a contract with one base year and four one-year options. All responsible sources may submit a capability statement, proposal or quotation, which shall be considered by the agency.
